It was alleged that he allowed his mount WITCHING HOUR to move outwards and to make contact with SHRKAN (T.R. Moseley) when not sufficiently clear, with approximately 350 metres to run.

Mr Bothamley pleaded guilty to the charge. The video evidence was quite clear. It demonstrated Mr Bothamley looking for racing room. Mr Hunter said his mount was "travelling well". Mr Bothamley moved outwards and in the process came into momentary contact with SHRKAN.

Mr Bothamley did not have any submissions to make on the incident. Mr P.D.J. Harris, a licensed trainer who supported Mr Bothamley in the hearing, submitted that the incident really was quite minor and that Mr Bothamley was trying to give his horse the best opportunity. He also said that Mr Moseley's mount was retreating and unaffected by the incident.

Penalty

Mr Hunter told the hearing that Mr Bothamley had a clean record for the past 12 months and was entitled to credit for an early guilty plea.

However, the aggravating feature was that Mr Bothamley failed to look out for a fellow rider when changing ground. Mr Hunter said this was not a good habit to develop. A rider must be clear when crossing the path of another horse. He did say that the incident would not have been as serious if Mr Bothamley had looked at where he was going.

Mr Hunter did not have a preference with regard to penalty. He did say that the carelessness was not at the higher end of the scale. Mr Bothamley said that he would prefer to be fined.

In imposing penalty, this Committee notes that as a general rule, apprentice riders are suspended rather than fined, and we see no reason to depart from this general rule.

We therefore suspend Mr Bothamley for two race riding days. In setting the suspension, it should be noted that we would normally have imposed a three day suspension, but having regard to Mr Bothamley's good record, his early guilty plea, and the fact that the carelessness was not at the higher end of the scale, we have allowed a day's discount.

Mr Bothamley is accordingly suspended until the conclusion of race riding on Saturday 5 February 2005.
