Following the running of Race 3, Ms LK Cropp, the rider of FRONTIER LAD, was charged with failing to ride her mount out when it had a chance of running into 3rd place.
| -- Rule: Rule 866(1)(c) --DECISION AND REASON --Introduction --Following the running of Race 3, Ms LK Cropp, the rider of FRONTIER LAD, was charged with failing to ride her mount out when it had a chance of running into 3rd place. --The Facts --The charge was denied. --Mr Ching alleged that some 3 to 4 strides from the winning post Ms Cropp relaxed her ride, and as a consequence of that she was beaten into 4th place by THE MEDICINE MAN which finished quickly on the outside of the track. The margin between 3rd and 4th was half a head which is quite a narrow margin. Mr Ching asserted that Ms Cropp was not aware of the presence of THE MEDICINE MAN. --Mr Ching showed the video evidence to support his allegations, using primarily the side-on camera view. --In reply, Ms Cropp stated that she was aware of the presence of THE MEDICINE MAN and that she believed that her horse was a "beaten horse" at the critical point from which the charge arose. She also said that her horse was "running about" and that it changed its striding several times in the run home. --Decision --There are two elements to the charge which must be established before we can find the charge proved. These elements are: --
We must be reasonably satisfied on the totality of the evidence that both elements have been established. We do not need to be persuaded "beyond reasonable doubt". --Did Ms Cropp fail to ride her horse out? Mr Ching alleged Ms Cropp "sat up" with 3 to 4 strides to go from the winning post. --Ms Cropp denied that, and stated that in her opinion "one more push" wasn?t going to make any difference. She stated that her horse was beaten at the point when Mr Ching alleges she stopped riding her horse. --We have carefully studied the video evidence. We have given careful consideration to Mr Ching's interpretation of Ms Cropp's ride, and to Ms Cropp's explanation. --On balance, we find that we cannot be reasonably satisfied that the first element has been made out. That being the case, we do not need to consider whether or not Ms Cropp's mount had a reasonable chance of running into 3rd place. --The information is accordingly dismissed. ----
