DECISION AND REASONS:
--Mr S C Ching, Stipendiary Steward, filed an information alleging that Mr K D Morrison, Holder of a Permit to Train, as the trainer of PRIORITY ONE, an acceptor for Race 9, Pub Charity Rating 72, presented that horse "with excessively worn or faulty plates".
----Mr Morrison was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.
----Mr Ching stated that Assistant Stipendiary Steward, Mr McLaughlin, was informed by the Plating Inspector that the rear shoes of PRIORITY ONE, which raced in Race 9, were excessively worn in his opinion and, on one plate, the toe clip had come loose which, in turn, had made the whole plate quite loose. The plates were replaced by the Club's farrier. The plates were produced to the Committee for inspection and their worn state was readily apparent.
----Mr Ching advised that Mr Morrison had not previously breached the Rule and, usually, "does an exemplary job in presenting his horses". Mr Ching recommended a fine in the region of $100.
----Mr Morrison stated that the front plates on PRIORITY ONE had been replaced during the week so there was no intention to present the horse the way it was. He accepted responsibility for the state of the plates. He said that he had informed the blacksmith that the horse was being
----turned out after today's race and asked his opinion of the state of the hind plates. The blacksmith informed Mr Morrison that he thought they were OK. In addition, the nail that was missing today was not missing at that time. In hindsight, it would have made sense to have had all four plates replaced rather that just the front plates, Mr Morrison said.
----Mr Morrison had no submission to make in relation to penalty.
----The Committee took the submissions of the parties into account as well as Mr Morrison's admission of the breach and that the fine recommended by Mr Ching was in line with fines imposed in other cases of a breach of the Rule.
----Mr Morrison was fined the sum of $100.00.
