Following the running of Race 4, a protest was lodged by Mrs J Hay, the trainer of SOUTHERN STORM (Mrs J Lawson).

DECISION AND REASON
--Following the running of Race 4, a protest was lodged by Mrs J Hay, the trainer of SOUTHERN STORM (Mrs J Lawson). It was alleged that ANGECA, the winner, ridden by Ms LK Young, angled out, coming into contact with SOUTHERN STORM. The official margins were 1? lengths between 1st and 2nd, a head between 2nd and 3rd, and a short head between 3rd and 4th.
--Mrs Hay alleged that the interference cost her horse at least 1? to 2 lengths. Mrs Lawson supported the protest and stated that as a result of the contact that was made, on the turn, that it took her some time to settle her mount before she could commence to ride with vigour. She alleged ANGECA came out again taking her line. Head on and side on video films were viewed.
--In reply, Mr S Kennedy, the trainer of ANGECA, stated that at the top of the straight ANGECA was travelling better than SOUTHERN STORM and that notwithstanding the contact, Mrs Lawson had plenty of opportunities to hit her horse with the stick. Ms Young said her movement was made to look worse than it was by virtue of the actions of OUTLOOK on the turn which contributed to her outward movement.
--Mr S Ching said there was contact at the turn and ANGECA did cause some inconvenience in the straight, but that it was over to this Committee to determine if there should be a change in the placings.
--In terms of Rule 876(1), in order to uphold a protest we must be satisfied that there has been interference and that such interference has affected the chances of the affected horse finishing in a better position. After considering all of the evidence, we must then exercise our discretion as to whether or not to amend the placings.
--After giving careful consideration to all of the evidence put before us, and after viewing the video evidence and bearing in mind the margin between 3rd and 4th, we find:

- There was some interference at the home turn but we doubt that in the overall situation that such interference affected the chances of SOUTHERN STORM.

- There was some inconvenience by ANGECA to SOUTHERN STORM in the straight, but in our opinion it was just that, namely inconvenience only. Mrs Lawson, in our opinion, had time to commence to ride with vigour after the incident at the top of the straight. In any event, the side on video demonstrated that ANGECA was well clear.
Therefore, we are not satisfied that there was sufficient evidence for us to make a determination that the placings should be changed.
--The protest is dismissed.
