The facts

--

P T Holmes (an apprentice jockey), the rider of POLSKI, has pleaded guilty to a charge of careless riding. He was accompanied in the hearing by Mr J D Laking, licensed jockey. Mr S C Ching, Stipendiary Steward, showed to the hearing the incident using the video films from the 600 metre camera and the head on camera.

As the field rounded the bend on the turn for home, Mr Holmes who was racing inside of ANCHOR ME (C W Johnson) shifted outwards to get around MACY GREY (J Todd). In so doing, POLSKI came firmly into contact with ANCHOR ME which was moved sideways as a result of the contact. C W Johnson maintained his line on ANCHOR ME and in so doing there was further contact by POLSKI with ANCHOR ME.

Mr Holmes, assisted by Mr J D Laking, acknowledged the first contact but said that in so doing he did not want to clip the heels of MACY GREY, and Mr Laking was of the view that C W Johnson had more or less caused the second incident whereby fine contact was made by holding POLSKI in.

Penalty

When imposing penalty for careless riding, we must consider a number of factors which include (and this is not intended to be an exhaustive list):

  • competitive riding;
  • --
  • contribution by the horse to the incident;
  • --
  • contribution to the incident by other horses;
  • --
  • rider safety;
  • --
  • rider's record.
--

In this case perhaps it was a wise decision on Mr Holmes' part to keep off the heels of MACY GREY. However in order to do so he had a duty to ensure that C W Johnson's safety was not compromised by his outward movement. We take the view that he did compromise C W Johnson's safety and a less experienced rider may well have been unseated. C W Johnson's mount was shifted out quite markedly as a result of the first contact that was made. Whilst Mr Holmes may have been riding competitively, the Rules of Racing do not permit a rider to barge his/her way out in order to gain a better position.

Insofar as C W Johnson is concerned, he was entitled to hold the line that he did and in our opinion did not contribute to the second contact that occurred.

In setting the penalty, we note Mr Holmes' recent record, and in particular the fact that he was suspended on 20th October for careless riding and fined on 15th October also for careless riding.

Mr Ching has suggested that a suspension is warranted. Mr Holmes has told us that his current suspension expires on Thursday 27 October and that as he has a good ride on 1st November he would like a one day suspension plus a fine.

We consider, having regard to all matters, that a suspension is the only penalty that can be imposed.

Mr Holmes is accordingly suspended from the close of racing on Thursday 27th October 2005 until the close of racing on Wednesday 2nd November 2005 which for Mr Holmes is effectively three days.

As a footnote, we were of a mind to make the suspension four days but we have given Mr Holmes credit for his early guilty plea.
