Decision:
Chief Stipendiary Steward Mr R. Sanders charged Apprentice Jockey Mr B R Lammas under Rule 520(4)(c) with allowing himself to be engaged to ride the horse “Vacant Lot” (14) in Race 10, the Valachi Downs South Island Thoroughbred Breeders Stakes, when he could not make the carded weight of 52.5kg.

--Mr Lammas was assisted at the hearing by Licensed Trainer Mr P. D. J. Harris, and they agreed that they understood the charge and the Rule it was brought under. Mr Lammas had indicated on the information that he admitted this breach of the rules and he confirmed this at the hearing.
--Mr Sanders gave evidence that Mr Lammas had advised the Stipendiary Stewards well in advance of Race 10 that he would not be able to make the weight, and a replacement rider was arranged. Mr Lammas was 1kg overweight.
--Mr Lammas explained that he had tried during the day to lose enough weight to take the ride, but that because of this he had felt weak and realised he could not continue to do so. He then approached the Stipendiary Stewards.
--Penalty:
--In relation to penalty Mr Sanders said that Mr Lammas had no relevant previous convictions, and that his admission of the breach should also be taken into account. It was also to Mr Lammas’ credit that he had advised the Stipendiary Stewards early. On the other hand this was a Listed Race and investors who had bet on the race early would have been misled that Mr Lammas was to ride the horse. Mr Sanders recommended a fine of no less than $200-00.
--Mr Lammas had no relevant submissions to make regarding penalty.
--We adjourned to consider our decision on penalty. We were satisfied that Mr Sanders had correctly set out the mitigating and aggravating factors in this case, and that the recommended fine of $200.00 was very fair in the circumstances. On returning to the Enquiry Room we advised the parties that Mr Lammas was fined the sum of $200.00.
