Following the running of Race 5, the Leslie Agencies Maiden, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 866(1)(c) alleging that Apprentice Jockey Mr R. J. Bishop failed to ride his horse "Gary The Lad" out to the end of the race.

DECISION AND REASONS:

Following the running of Race 5, the Leslie Agencies Maiden, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 866(1)(c) alleging that Apprentice Jockey Mr R. J. Bishop failed to ride his horse "Gary The Lad" out to the end of the race.

Mr Bishop had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing. Both Mr Bishop and Mrs Williams also acknowledged that they understood the Rule and the nature of the charge.

--

Mr Ching used video coverage of the incident to show that Mr Bishop rode his horse with some vigour nearing the end of the race, but then stopped riding it a short distance from the winning post. "Gary The Lad" was beaten for 2nd place in the last couple of strides.

On behalf of Mr Bishop, Mrs Williams said that this was an unfortunate incident and an error of judgement by a young jockey who had only 4 or 5 rides at Riccarton. Mrs Williams also believed that Mr Bishop would learn a lot from this experience.

PENALTY:

--

In relation to penalty Mr Ching advised that Mr Bishop had no relevant convictions, and that he should also be given credit for his admission of the breach.

Mr Ching also said that he believed that Mr Bishop’s breach had cost his horse second place, and this had resulted in the loss of $700-00 in stake money for the owners, and had also affected quinella and trifecta investors.

Mr Ching emphasised that this was a serious breach of the Rules and that a suspension of 4 – 6 weeks would be appropriate.

Mr Ching was asked if he had details of any previous similar breaches and the penalties imposed. The only one that came to mind was a charge against Jockey Lisa Cropp about three years ago, but the actual penalty imposed in that case was not known.

On behalf of Mr Bishop, Mrs Williams said that it would be unhelpful if he was suspended for a long period, as he needed the practice and experience from riding.

It was confirmed that Mr Bishop only rode at South Island race meetings. It was also discussed whether Mr Bishop wanted to avail himself of the "7 day rule" which allowed for a delay to the start of a suspension. This rule would have enabled Mr Bishop to continue riding up to and including Saturday 28 December 2007. Mr Bishop advised that he had arrangements to ride at Otago on 26 December 2007, but that the suspension could start after that date.

We retired to consider the matter of penalty. We accept the submissions of Mr Ching that a breach of this Rule is serious. We also accept that it is very likely Mr Bishop lost second place when he stopped riding his horse. We do not find as a fact that this is the case.

In coming to our decision on penalty we are satisfied that a suspension for a period of one month would have been appropriate in this case. However this is a busy time of the year for South Island racing, and a one month suspension at this time would, in our opinion, be excessive. We therefore decided that Mr Bishop was to be suspended from 27 December 2007 to 12 January 2008, both dates inclusive. This suspension includes 7 South Island race days.
