Following the running of Race 8, the Armourguard Rating 70, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging Jockey A. M. Mundy rode carelessly when allowing her horse “Irish Jig” (3) to shift in at the 350 metre mark when not clear.

Following the running of Race 8, the Armourguard Rating 70, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 871(1)(d) alleging Jockey A. M. Mundy rode carelessly when allowing her horse “Irish Jig” (3) to shift in at the 350 metre mark when not clear.

Miss Mundy had indicated on the information that she admitted this breach of this Rules, and she confirmed this at the hearing.  Miss Mundy also acknowledged that she understood the Rule and the charge.

Stipendiary Steward Mr Davidson illustrated this incident by means of video coverage, and showed that Miss Mundy had allowed her horse to move inwards as described in the information.

Mr Ching said that the breach was mid-range.  Miss Mundy explained that she had hit her horse once behind the saddle which caused it move inwards.  She hit her horse again instead of straightening it.

PENALTY:

In relation to penalty Mr Ching advised that Miss Mundy had an excellent record and had not previously been charged with careless riding.  Also it should be taken into account that she had admitted the breach.  Mr Ching recommended that a suspension of 4 – 5 days would be appropriate in this case.

Miss Mundy said that she thought the suspension recommended was harsh.

We adjourned to consider the matter of penalty.  We were very impressed by Miss Mundy’s excellent riding record.  We also took into account her admission of the breach.  We agreed that a starting point for a suspension in this case was 4 – 5 days as recommended by Mr Ching.  However taking all matters into account we decided that a 3 day suspension was appropriate in this case.

On returning to the Enquiry Room we advised the parties of our decision and the reasons for it.  We advised that Miss Mundy’s Jockey’s Licence was suspended from after the completion of racing on Sunday 21 December 2008 until after the completion of racing on Tuesday 30 December 2008, this being a 3 day suspension.
