Facts:
Following the running of Race 5, the Smiths Loos Maiden, an information was filed by Stipendiary Steward, Mr J M McLaughlin, against Licensed Apprentice Jockey, Ms C R Barnes, alleging a breach of Rule 638 (1) (d) in that Ms Barnes, as the rider of SERAPHIM FALLS in the race, “allowed her mount to shift in near the 150 metres resulting in BOUJET LA (K Williams) having to be checked”.
Ms Barnes was present at the hearing of the information and she indicated that she admitted the breach. She was assisted at the hearing by Licensed Trainer Mr M P McCann.
Rule 638 provides as follows:
(1) A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Submissions for Decision:
Mr McLaughlin with the assistance of Stipendiary Steward Mr M Zarb, showed video replays of the relevant part of the race, near the 150 metres. He pointed out Ms Barnes, riding SERAPHIM FALLS, when in contention, racing on the outside and forward of BOUJET LA (K Williams). SERAPHIM FALLS was hanging in at this point and when Ms Barnes elected to use the whip on 3 occasions, SERAPHIM FALLS ducked inwards abruptly when not clear of BOUJET LA causing that horse to check. It was submitted that SERAPHIM FALLS was only 1 length clear of BOUJET LA when shifting inwards. Mr Zarb submitted that Ms Barnes should have known that with SERAPHIM FALLS hanging in, it was very likely that the horse would shift inwards if struck with the whip. He also submitted that even when Ms Barnes put the whip away she was still too slow in taking corrective action with her mount. He stated that if Ms Barnes had only struck SERAPHIM FALLS once, realised the horse was shifting in and took corrective measures, she would not be on a charge.
Mr McCann submitted that a lot of fault with the incident could be attributed to the horse. Ms Barnes submitted that it was first time she had ridden SERAPHIM FALLS and that the mare had raced ungenerously during the running. She stated that the horse’s previous riders had all been senior jockeys.
Reasons for Decision:
Ms Barnes having admitted the breach, the charge was found proved.
Submissions for Penalty:
Mr McLaughlin submitted credit should be given to Ms Barnes for her early admission of the breach and that in the Stewards' opinion the breach was at the lower end of the scale. Mr McLaughlin stated Ms Barnes had a very good penalty record and that she had had only one breach of this Rule over the past 12 months being a 2 day suspension imposed at Timaru Racing on 24 August 2012. He submitted that a suspension for a “minimum term”, 2 days, was appropriate in this case.
Ms Barnes made no submission in regard to penalty.

In arriving at penalty, the Committee took into account Ms Barnes’ admission of the breach and her riding record, which was acknowledged as “very good” by Mr McLaughlin. The Committee noted Mr McLaughlin’s submission as to an appropriate penalty. The Committee also took into account that, in its view, the breach was at the lower end of a scale of seriousness.
