As Miss Jamie had admitted the breach, the charge was found proved.

Penalty:

Miss Jamie’s Class B Jockeys licence is suspended from the conclusion of racing 12 October up to and including 27 October 2018.

Facts:

Following the running of Race 3, the Auto Express Wash Rating 72, an Information was filed by Stipendiary Steward, Mr M Williamson, against Class B Rider, Miss S Jamie, alleging careless riding in that she permitted her mount, FIRE LILY, to shift outwards near the 800m casing DIRECTOR, ridden by Mr J Laking, to be galloped on as a result.

Rule 638 reads as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”

Miss Jamie had indicated on the Information that this breach of the Rules was admitted, which she confirmed at the hearing. Miss Jamie also agreed that she understood the charge and the Rule it was brought under.

Mr D Walsh, NZTR Apprentice Mentor, assisted Miss Jamie at the hearing.

Mr Williamson gave evidence and used video coverage, with the assistance of Stipendiary Steward, J Mclaughlin, to show that nearing the 800m, FIRE LILY, ridden by Miss Jamie, was racing midfield on the rail with RICHARD OF YORKE, ridden by Mr C Campbell on her outside, with DIRECTOR, ridden by Mr J Laking ahead of Mr Campbell. Mr McLaughlin showed Miss Jamie shift outwards into ½ a gap on her outside making contact with RICHARD OF YORKE who attempted to hold its position. Miss Jamie, he said, continued on a shift outward when not clear, and was forced onto the heels of DIRECTOR who was severely galloped on and retired from the event. Mr Williamson stated that DIRECTOR suffered serious injury to its hind leg tendons and after examination from the club’s veterinary surgeon was humanely euthanised.

Mr Walsh said that Miss Jamie had made a couple of wrong decisions in the race. He said there was quite a build up to this incident. Mr Walsh said that her horse was quite keen leading up to the incident and the lead horse was easing which made it worse for her. Unfortunately, he said, Mr Campbell had just left enough of a gap between them which Miss Jamie took advantage of, possibly because she may not have been able to steady her mount. Mr Walsh stated that Mr Campbell was entitled to hold his position and resist her outward movement. He submitted that this made the situation worse and forced Miss Jamie onto the hind legs of DIRECTOR. He also submitted that had Mr Campbell let Miss Jamie out this incident may not have happened.

Miss Jamie stated that she was getting up onto the heels of the horse in front and tried to take a hold of her horse. But the horse, she said, bored down and she shifted out in an attempt to take advantage of the room outside of her to relieve her situation.

Mr Walsh added that the horse was a strong horse and could pull therefore, not the easiest to ride. He said that Miss Jamie ended up on the wrong horse, in the wrong position and everything went haywire from there. He also stated that Miss Jamie thought she was doing the right thing by shifting away from danger and clipping heels but finished creating a worse situation.

Submissions for Penalty:

Mr Williamson stated that Miss Jamie’s record was clear and that she had to date had only 6 race day rides. He stated her inexperience must be taken into consideration, however she has made a poor decision, none the less a split-second one, which easily can be made by other riders. She put herself in a poor position on the heels of DIRECTOR and as a result the horse has been galloped on, suffering tendon injuries. The horse, he said, was taken off the course but was unable to be saved and as a result of those injuries, was humanely euthanised.

Mr Williamson stated that it was imperative that both riders and horses have confidence in coming to the races without suffering any unnecessary injuries. Safety is one of the paramount factors in racing as well as punter confidence. He said that a warm favourite, DIRECTOR, has been taken out of the race as a result of Miss Jamie’s actions. Mr Williamson submitted that the consequences of Miss Jamie’s riding was high and the whole incident he assessed as high end. Mr Williamson said that after taking all factors into consideration, submitted that a suspension no less than 10 National Days be considered as penalty in this case.

Mr Walsh stated that Mr Williamson had summed up the case very fairly.

Mr Williamson added that Miss Jamie would undergo intense tutorage from Mr Walsh and her employer Mr L Robinson.

Deferment was discussed with Miss Jamie seeking a deferment until after racing on Friday 12 October at Timaru where she had a riding commitment.

Reasons for Penalty:

The JCA Penalty Guide provides a 6 National day starting point for a low-level breach of this rule, 8 days for a mid-range and 10 days for a high-level breach. This Committee assessed this breach as mid to high level and accordingly adopted a 9 National day starting point. The aggravating factor in this case is the high level of consequences of Miss Jamie’s carelessness which warranted an uplift in penalty. This uplift we set at 4 days. We were however able to afford Miss Jamie a discount for her admission of the breach and her relative inexperience. This we set at 1 day. We therefore determined that a 12 National day suspension was an appropriate penalty in this case.

Miss Jamie’s request for deferment until after racing at Timaru on 12 October was granted.
