Facts:
Following the running of Race 1, Weston Milling Premier, an information was filed by Chief Stipendiary Steward, Mr C J George, against Licensed Jockey, Mr L M Robinson, alleging a breach of Rule 638 (1) (d) in that “near the 1200 metres Mr Robinson allowed his mount (TOUGH NUT) to shift in when not clear of SASHENKA (C A Spittles) which had to be checked and lost ground”.
Mr Robinson was present at the hearing of the information and he indicated that he admitted the breach.
Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Submissions for Decision:
Mr George had Stipendiary Steward, Mr A L Ray, show the incident on video replays. Mr Ray pointed out Mr Robinson on TOUGH NUT, racing 3-wide some 400 metres after the start of the 1600 metres race with SASHENKA (C A Spittles) behind him and racing 2-wide. Mr Robinson then shifted in to a 2-wide position behind MICKY O’REILLY (T R Moseley) and, in doing so, forced Miss Spittles to check her mount. Mr Ray submitted that it was clear, from the side-on video, that Mr Robinson was not his own length and another length clear.
Mr Robinson said that, as he was coming across, his mount was lugging in slightly which inconvenienced him. However, he conceded that he was not clear when he crossed.
Submissions for Penalty:
Mr George said that Mr Robinson’s record showed that he had received a suspension for careless riding on 9 June 2011. It was a good record. He said that there had not been significant interference – it was in the medium range. He submitted that Mr Robinson was a South Island rider.
Mr Robinson told the Committee that he had an engagement to ride a horse on the 3rd day of the meeting on Saturday, 12 November 2011, and he therefore sought a deferment of any suspension to enable him to take that engagement. He also told the Committee that he would have been taking rides at the meeting of Levin Racing Club on 25 November 2011.
Reasons for Penalty:
In assessing penalty, the Committee had regard to Mr Robinson’s frank admission of the breach and his good riding record, which Mr George acknowledged. The Committee took, as a starting point, a term of suspension of 5 days. It was prepared to reduce this, having regard to those mitigating factors and the fact that the offending was in the low-mid range.
