Facts:
Following the running of Race 6, the PGG Wrightson Seeds Open Handicap, an Information was filed by Stipendiary Steward Mr M Williamson against Class B Licensed Apprentice Jockey Miss A Morgan, alleging a breach of Rule 638(3)(b) in that she used her whip excessively on JAZZMAN, prior to the 200m.
Rule 638(3)(b) reads as follows:
“(3) A rider shall not:
(b) strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper;
Miss Morgan had indicated on the Information that the charge was admitted which was confirmed at the hearing. She also confirmed that she understood the rule she was being charged with. Miss Morgan was assisted at the hearing by her employer, Mr M Pitman.
Mr Williamson gave evidence and produced video replays with the assistance of Stipendiary Steward, Mr J McLaughlin, which showed Miss Morgan riding JAZZMAN, who was in the lead as the field passed the 400m. He pointed out Miss Morgan drawing her whip and using the whip on 4 occasions then pushing for 1 to 2 strides before using the whip again on a further 4 occasions. He said this was followed by pushing for 1 to 2 strides and using the whip again on a further 5 occasions prior to the 200m. He stated that Miss Morgan had used the whip in the final straight on 13 occasions. Mr Williamson stated that the reason Miss Morgan was being charged was that she had failed to go back to the whip rein with her whip hand and push for 6 strides after using the whip in the final straight as required by the Whip Guidelines prior to the 200m.
Miss Morgan stated that she was sorry and as it was her first day back riding after quite a period of time away from race riding, had just forgotten about the Whip Guidelines.
Submissions for Penalty:
Mr Williamson stated that Miss Morgan was having her first day back race riding for quite some time and that the breach was at a low level. He also said that the strikes were not forceful and Miss Morgan had a clear penalty record in regard to the Rule. Mr Williamson stated that Miss Williams had admitted the breach at the first opportunity. He submitted that a fine consistent with penalties of similar breaches be considered as penalty.
Mr Pitman asked that consideration be given to the fact that Miss Morgan had just come back race riding after an absence of 2 years. He also asked that consideration be given to her frank admission of the breach, her good record and the low level of the breach.
Reasons for Penalty:
In determining penalty the Committee adopted the JCA Penalty Guide recommendation of a starting point of a $500 fine. There were no aggravating factors in this case to warrant an uplift in penalty, only mitigating factors to consider. We were however, able to afford a discount of $100 for Miss Morgan’s clear record and the low level of the breach. We were also able to afford a further combined discount of $150 for her frank admission of the breach, her status as a Class B Apprentice Rider and the fact that this was Miss Morgan’s first day back race riding in 2 years. We therefore determined that an appropriate penalty was a fine of $250.
