Accordingly, Mr Parkes Class A Jockey licence is suspended from the conclusion of racing 8 November, following racing at Hastings, up to and including 25 November 2020.
Facts:
Following the running of Race 8, the Al Basti Equiworld Dubai 48th New Zealand 2000 Guineas, an Information was filed by Chief Stipendiary Steward, Mr J Oatham, against Class A Rider, Mr J Parkes, alleging careless riding in that he allowed his mount LORD ARDMORE to shift in when not clear of MARINE ( M McNab) who clipped a heel and blundered passing the 1100m.
Rule 638(1)(d) reads as follows;
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Parkes had indicated on the Information that this breach of the Rules was admitted, which he confirmed at the hearing. Mr Parkes also acknowledged that he understood the charge and the Rule it was brought under.
Mr Oatham gave evidence and used video coverage, with the assistance of Stipendiary Steward, Mr M Davidson, to show that approaching the 1100m, LORD ARDMORE, ridden by Mr Parkes, was racing three off the rail and mid field with MARINE, ridden by Mr M McNab, racing on Mr Parkes' inner. Mr Davidson pointed out on the films that MARINE was over racing leading up to the incident.
Mr Davidson indicated Mr Parkes, who was looking to shift in and find cover. He pointed out Mr Parkes shift in when not clear of MARINE and as a result MARINE clipped a heel and blundered. Mr Davidson said that Mr Parkes had attempted to follow UNITION, ridden by Mr M Cameron, into a 1 off position and had only been a bare length ahead of MARINE, when shifting into its rightful line of running. He added that Mr Parkes did correct his mount albeit too late to prevent the check.
Mr Parkes stated that at the time of the incident he was following Mr Cameron who was racing one off and he had just presumed that he was one off as well. He said he heard Mr McNab call out and he has corrected his mount but too late. Mr Parkes added he had made a misjudgement.
Submissions for Penalty:
Mr Oatham stated that Mr Parkes has an excellent riding record with no breaches of any Rule on record in the previous 12 months. In mitigation Mr Oatham stated that MARINE was over racing at the time of the incident, but that Mr McNab had stated that he was always entitled to be where he was. He stated that it was fortunate that MARINE made such a good recovery otherwise we would have been dealing with a fall. Mr Oatham stated the carelessness was mid to high level with an aggravating factor being the status of the race, Group 1 with a $500,000 stake payable.
He submitted that after taking all factors into account, a suspension in the vicinity of 2 weeks or 10 riding days be considered as penalty in this case.
Mr Parkes asked that his good record be taken into account and that he did not seek a deferment of penalty, wishing to begin any suspension as soon as possible after his rides at Hastings on 8 November.

This Committee also assessed this breach as mid to high range and accordingly adopted a 9 national day starting point.
We determined that the aggravating factor to consider was the status of the race, Group 1 with a stake payable of $500,000. This aggravating factor warranted an uplift in penalty which we set at 3 days. The mitigating factors are Mr Parkes ready admission of the breach and his exceptionally good record which warranted a combined discount. This discount we set at 2 days. We therefore determined that a 10 National Day suspension was an appropriate penalty in this case.
