The Committee, pursuant to Rule 902 (2) (a) (iii), ruled that the race be null and void. There was no suggestion that the race should be run again.
Facts:
Following the running of Race 1, Waimakariri Businesses Maiden, an information was filed by Stipendiary Steward, Mr J M McLaughlin, requesting a ruling that the race be declared null and void on the ground that “most runners in the race were affected when having to negotiate and avoid cones left on the course near the 1000 metres”.
Club representatives, Messrs T W Mills and J R Langan, were present at the hearing.
Rule 902 provides as follows:
(2) The functions of a Judicial Committee shall be:
(a) from the commencement of the first proceeding which it commences to deal with on any day of a Race Meeting or one hour prior to the starting time of the first Race of that day until after the conclusion of the last proceeding which it commences to deal with on that day, or thirty minutes after the last Race run on that day (whichever is the later) to:
(iii) declare a Race null and void and if it thinks expedient order that such Race be run again.

Mr McLaughlin showed head-on and side-on video replays of the relevant part of the race – an 1800 metres event for maidens. He showed the field approaching the bend out of the back straight near the 1000 metres. At that point on the track there were fourteen plastic cones on the track extending out from the running rail. He pointed out RED BULLET run off and dislodge its rider, Ashley McKay. It took THE DRAFTER and DUNROAMIN wide. The leader, JIMMY THE ONE had “ploughed through” the cones and the horse running 2nd had jumped them. All riders had taken hold of their respective mounts and eased. The riders had expressed shock that this had happened, Mr McLaughlin said. Almost all said that their chances in the race had been affected.
Mr Mills, Chief Executive Officer, agreed that the race should be declared null and void.
Reasons for Decision:
The Committee was satisfied that the evasive action taken by jockeys in the race to avoid the cones on the track had resulted in one runner losing its rider and two or three others losing considerable ground and, effectively, their chances. Almost the entire field had been affected to some degree, turning the race into a contest where the runners could not compete effectively on even terms, although most of the field continued on and finished the race. Some of the runners in the race were denied the opportunity of competing to the finish of the race and therefore the race was not a fair contest.
