Miss Farr having admitted the breach, the charge was found proved.

Miss Farr’s Apprentice Jockey’s (Class B) licence is suspended from after the close of racing on Saturday, 13th August 2016, up to and including Friday, 19th August 2016 – 2 riding days. The two meetings intended to be encompassed by the term of suspension are Avondale JC on 17th August and Racing Taupo on 19th August. 

Facts:

Following the running of Race 10, Ekraar at Linwood Park Premier, an information was filed by Stipendiary Steward, Mr J P Oatham, against Licensed Apprentice Jockey (Class B), Miss E J Farr, alleging that Miss Farr, as the rider of NO CHANGE in the race “used her whip excessively prior to the 200 metres”.

Miss Farr was present at the hearing of the information and she indicated that she admitted the breach. Assisting her at the hearing was Apprentice Jockey Mentor, Mr W Harnett.

Rule 638 provides as follows:

(3) A Rider shall not:

    (b) strike a horse with a whip in a manner or to an extent which is: 

         (ii) excessive.

The Guidelines for Use of Whip provide:

Once a horse enters the final straight it can be hit with the drawn whip up to six times and then the rider should ride hands and heels for six strides before hitting the horse again with the drawn whip and continue this action until the 200 metres.

Mr Oatham showed a video replay of the final 300-400 metres of the race. He pointed out Miss Farr, riding NO CHANGE, racing mid-field and away from the running rail as the field entered the home straight. Mr Oatham then showed that Miss Farr pulled her whip and used it approximately 14 times, a relatively high number he submitted, prior to the 200 metres. Mr Oatham said, to be fair to Miss Farr, there were a lot of pauses but, unfortunately, she had not stopped at any stage for the required six strides. Stewards saw the breach as being no worse than “low end”. Track conditions were “fairly testing” on the big track with a long straight. Today’s meeting was the first time that Miss Farr had ridden in a flat race on the track, so Stewards had some sympathy for her, Mr Oatham said.

Miss Farr said that she admitted that she had used her whip too many times. The strikes were mostly backhand and not with a lot of force, she submitted. It was a long straight and the horse is difficult and raced a bit erratically, she added. She said that she was not strong enough to keep pushing her mount for the required six strides and still maintain rhythm.

Mr Harnett said that the horse was not easy to ride and Miss Farr had been caught out by the long straight.

Submissions for Penalty:

Mr Oatham told the Committee that Miss Farr had come to New Zealand from the United Kingdom with only limited experience before arriving here. She had come here as a jumps rider but, during the season just ended, she had got her weight down to where she was able to take out an apprenticeship, Mr Oatham said. She had been riding with some success, but was still inexperienced on the flat.

Miss Farr had breached the whip Rule on 24th July 2016 at Racing Te Aroha and had been fined $250 on that occasion. On 29th July 2016 at Avondale, Miss Farr had again breached the Rule and received a 2-days’ suspension. Both breaches had been “low end”, Mr Oatham said. Mr Oatham informed the Committee that Miss Farr had some good opportunities in the coming week but, more importantly, on 20th August, she will be riding the horse likely to be favourite for the Great Northern Hurdles at the Pakuranga Hunt meeting.

Mr Oatham submitted that a suspension of two days would be appropriate for the present breach. For Miss Farr to miss the ride in the GN Hurdles would make the penalty out of proportion to the gravity of the breach, he said. 

Reasons for Penalty:

In determining penalty, the Committee took into account that Miss Farr had frankly admitted the breach. In addition, the Committee saw the breach as being at the very low end on a scale of seriousness. These were mitigating factors that the Committee took into account.

The Committee was moved by Mr Oatham’s submission for a 2-days’ suspension. Miss Farr’s record was a matter of concern to us and would, under normal circumstances, warrant a suspension of at least 3 days for this breach. However, we accept that there are exceptional circumstances in this case, having regard to the approaching GN Hurdles.

The Committee was prepared to accept Mr Oatham’s submission that the two previous breaches were both relatively minor. We accepted that the present breach was also minor. It was appropriate for the Committee to give Miss Farr some encouragement in her riding career while, at the same time, making it clear to her that she cannot continue to breach the Rule.

Miss Farr was advised that the Committee had taken a rather lenient view of her offending and, with some reservations, was prepared to accept Mr Oatham’s submission for a 2-days’ suspension. It was explained to her that this was on the basis that she would urgently and earnestly address her whip riding issues. She was also issued a warning that any further breach before the reset period of 6 months can be applied is likely to attract a significant term of suspension of her Apprentice Jockey’s licence.
