As Mr Chowdhoory had admitted the breach, the charge was found proved.
Penalty:
Mr Chowdhoory’s application for a deferment until after racing at Dunedin on 6 February was granted.
Accordingly, Mr Chowdhoory’s Class B Jockeys Licence is suspended from the conclusion of racing 6 February 2021 up to and including 17 February 2021. In addition, a fine of $500 was imposed.
Facts:
Following the running of Race 7, the D Reynolds Electrical Rating 65, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class B Rider, Mr K Chowdhoory, alleging careless riding in that he permitted his mount IMAKEEPA to shift inwards dictating ATAAHUA DREAMTIME inwards onto ARE YOU CEREAL, which was checked near the 1100m.
Rule 638(1) (d) reads as follows;
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Chowdhoory had indicated on the Information that this breach of the Rules was admitted, which he confirmed at the hearing. Mr Chowdhoory also confirmed that he understood the charge and the Rule it was brought under. Mr Chowdhoory was assisted at the hearing by Licensed Trainer, Mr M Pitman.
Mr Davidson gave evidence and used video coverage, with the assistance of General Manager of Stewards, Mr N McIntyre, to show that nearing the 1100m, IMAKEEPA, ridden by Mr Chowdhoory, was racing three wide with ATAAHUA DREAMTIME, ridden by Mr J Lowry racing on the inside of IMAKEEPA and ARE YOU CEREAL, ridden by Mr T Moseley on the rail and inside ATAAHUA DREAMTIME. He pointed out Mr Chowdhoory shift inwards when not clear, in an attempt to take up a position forward of those two runners, resulting in Mr Lowry being dictated inwards and as a result, Mr Moseley had to check his mount. Mr McIntyre stated that Mr Chowdhoory was only a bare length in front of ATAAHUA DREAMTIME when making this manoeuvre.
Mr Chowdhoory stated that he had made an error of judgement.

Mr Davidson stated that Mr Chowdhoory’s record showed 4 previous breaches of this Rule over the prior 12 months being.

-18 September 2020 at Ashburton- 5 National days
-26 December 2020 at Otago- 4 National days and fine $500
-9 January 2021 at Kumara-5 National days and fine $750
Mr Davidson stated that the breach was low to mid with the only aggravating factor being Mr Chowdhoory’s record. He submitted that a suspension and fine with consideration to the level of the breach and his record as an aggravating factor be considered as penalty.
Mr Chowdhoory elected to make no submissions on penalty apart from requesting a deferment of suspension until after racing at Dunedin on 6 February 2021.
Reasons for Penalty:
The JCA Penalty Guide provides, for a mid-range breach of this Rule, a 5-day suspension and a $500 fine. This Committee assessed this breach as mid to low range and accordingly adopted a 5 national day and $350 fine starting point. We considered Mr Chowdhoory’s record of 4 previous breaches over the prior 12 months to be an aggravating factor, which warranted an uplift. This uplift we set at 2 days and $150. Mr Chowdhoory’s frank admission of the breach was a mitigating factor which warrants a discount of penalty. This discount we set at 1 day. We therefore determined that a 6 National day suspension and $500 fine was appropriate.
