Facts:

Information No.A6365 was filed by Stipendiary Steward, Mr J P Oatham, against Licensed Trainer (Class A), Mr D M Crozier, alleging that Mr Crozier, as the trainer of CAVATINO in Race 4, Berkley Stud Selling @ Festival Sale Rating 65, “presented CAVATINO to race without the lead bag which was left off the gear”.

Mr Crozier was present at the hearing of the information and he indicated that he admitted the breach.

Rule 614 provides as follows:

(2) A person must not be neglectful or careless in saddling a horse.

Mr Oatham said that Stipendiary Steward, Mr J W McLaughlin, was at the inspection area when CAVATINO was presented for Race 4 without the lead bag. The lead bag was not a particularly large one and did not have any lead in it, Mr Oatham said – it weighed only 300 grams. The lead bag was produced to the hearing.

Mr Crozier pointed out that there was no lead in the bag. He explained that it had fallen off the rail to the ground while he was saddling CAVATINO and he had not noticed it. Mr McLaughlin had picked it up on the way through, he said. He had been training for approximately 5 years and this was his first gear-related breach in that time. He was embarrassed about it, he said.

Submissions for Penalty:

Mr Oatham confirmed that Mr Crozier’s record was clear. He submitted that the integrity of the saddling process was of the utmost importance and it was fortunate, in this case, that the omission of the lead bag had been detected at the inspection stage so that it could be rectified. He further submitted that a fine in the vicinity of $300 was an appropriate penalty, having regard to Mr Crozier’s admission of the breach and his good record.

The Penalty Guide starting point is now a fine of $500 having been higher that that previously, Mr Oatham said. Most fines under the previous starting point were in the vicinity of $500.

Mr Crozier did not wish to make any submission in relation to penalty.

Reasons for Penalty:

The Committee noted that the starting point for penalty under the Penalty Guide for a breach of the Rule is a $500 fine. Mr Crozier was entitled to a discount from that starting point for his frank admission of the breach and his good record. The Committee fixed that discount at $200.
