Mr Turner having admitted the breach, the charge was found proved. 

Penalty:

Mr Turner’s apprentice jockey’s licence is suspended from and including 11 August 2013 up to and including Saturday 17 August 2013 – effectively, 4 riding days. The days intended to be encompassed by the term of suspension are Matamata on 12 August, Whangarei on 14 August, Hawera on 15 August and Te Rapa or Otaki on 17 August.

Facts:

Following the running of Race 10, Speight’s Premier, an information was filed by Co-Chief Stipendiary Steward, Mr R L Neal, against Licensed Apprentice Jockey (Class B), Mr D L Turner, alleging that Mr Turner, as the rider of THE LONE RANGER in the race, “at approximately the 400 metres rode his mount carelessly when shifting outwards causing interference to CHEEKY TART (R A Doherty)”.

Mr Turner was present at the hearing of the information and he indicated that he admitted the breach. He was assisted at the hearing of the information by Apprentice Jockey Mentor, Mr Will Harnett.

Rule 638 provides as follows:

(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
    (d) careless.

Submissions for Decision:

Mr M Zarb, Stipendiary Steward, showed rear-on and side-on video replays of the final 300 to 400 metres of the race. He pointed out THE LONE RANGER, ridden by Mr Turner and CHEEKY TART, ridden by Mr Doherty. THE LONE RANGER was being “pushed along” looking for somewhere to go. There was no room in front and Mr Turner was looking to come out. When not clear of CHEEKY TART, Mr Turner turned his mount’s head outwards and forced that runner wider on the track, taking its line of running and causing it to become unbalanced.

Mr Harnett submitted that the horse had been “ungenerous” from the start of the race. The horse has a record of racing ungenerously, he said. It had been hanging prior to Mr Turner angling it out. The interference was exacerbated by the fact that it happened right on the point of the bend. It did not help that it was Mr Turner’s first ride on the track, Mr Harnett submitted. The horse was the favourite for the race and Mr Turner was keen to “get it out and running”. 

Submissions for Penalty:

Mr Neal provided details of Mr Turner’s record to the Committee. He has had one suspension for careless riding – on 17 January 2013 at Taranaki, for which he received a suspension. It was a significant breach as it resulted in a fall, resulting in a suspension of 3 weeks for Mr Turner. He had had a number of weight-related charges since that time, Mr Neal said.

Mr Neal informed the Committee that Mr Turner is an apprentice with “some potential” and has been riding a number of winners in recent months. He is progressing well in his career but, on this occasion, has made an error of judgement in that he has angled his mount out to obtain clear running. This was the primary reason for the interference caused to CHEEKY TART although, to some degree, it was due to the manners of THE LONE RANGER because the horse did hang out.

Mr Neal said that the Stewards put the interference in the low-to-mid range. Mr Neal agreed with the submission of Mr Harnett that Mr Turner was not helped by the fact that it happened right on the point of the turn into the straight.

Mr Neal submitted that Mr Turner’s admission of the breach and the fact that the horse had “amplified” the interference were mitigating factors. His record was “reasonable” under the careless riding Rule.

Mr Neal then informed the Committee that Mr Turner commences another term of suspension following this meeting for a weight-related offence. That suspension ends after racing on 10 August 2013. 

Reasons for Penalty:

In determining penalty, the Committee took a starting point of 5 days as recommended in the Penalty Guide. Mr Turner was entitled to a discount of 1 day for his admission of the breach and the fact that the breach was in the low-to-mid range. The Committee agreed with Mr Neal in that regard. These were mitigating factors. There were no particular aggravating factors. Mr Turner’s record was good.
