Miss McGregor having admitted the charge, the charge was found to be proved. 

Penalty:

Miss McGregor’s jockey’s licence was suspended for a period commencing after the close of racing on Tuesday, 30 October 2012, up to and including Saturday, 10 November 2012 – effectively 3 days. Miss McGregor acknowledged that she is a South Island rider. The three South Island meetings intended to be included in the period of suspension are Banks Peninsula on 4 November, Dunedin on 6 November and Riccarton on 10 November 2012.

Facts:

Following the running of Race 3, NZB Ready to Run Sale Two-Year-Old, an information was filed by Stipendiary Steward, Mr M Zarb, against Licensed Jockey (Class A), Miss L D McGregor, alleging a breach of Rule 638 (1) (d) in that Miss McGregor “permitted her mount CHOICE SNITZEL to shift outwards passing the 350 metres when not clear causing THAT’S WHERE IT IS (J S Bullard) to be checked”.

Miss McGregor was present at the hearing of the information and she indicated that she admitted the breach.

Rule 638 (1) (d) provides as follows:

(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
     (d)  careless.

Submissions for Decision:

Mr Zarb showed head-on and side-on video replays of the final 400 metres of the race. He pointed out CHOICE SNITZEL, ridden by Miss McGregor, second from the outside, with THAT’S WHERE IT IS, ridden by Mr Bullard, on its outside. He then pointed out Miss McGregor, with approximately 350 metres to run, permit her mount to shift out, resulting in THAT’S WHERE IT IS having to be checked. In response to a question from the Committee, Mr Zarb agreed that Miss McGregor was no more than her own length clear when she shifted out. This was accepted by Miss McGregor.

Miss McGregor admitted that she was not clear when she shifted out and that she had caused the interference to THAT’S WHERE IT IS. She suggested that the filly, a 2-year-old, may have overreacted and made the interference look worse.

Submissions for Penalty:

Mr Zarb stated that the Stewards regarded the breach to be at the higher end of a scale of carelessness and the consequences to THAT’S WHERE IT IS were also at the higher end.

Mr Zarb said that Miss McGregor had a clear record and she had admitted the breach.

Miss McGregor said that she had four declared rides for the meeting at Timaru on Tuesday, 30 October, and she sought a deferment of any suspension to enable her to complete those engagements. 

Reasons for Penalty:

In determining penalty, the Committee had regard to Miss McGregor’s previous good record and her very frank admission of the breach. However, the breach was in the mid-to-high range, in the Committee’s view, as she was barely her own horse’s length and another length clear and, further, the interference to THAT’S WHERE IT IS was at the higher end. The Committee noted that CHOICE SNITZEL finished in 3rd placing.
