As Miss Jonker admitted the breach the charge is found proved.

Miss Jonker is suspended for 2 riding days from the close of racing on Saturday 28 January 2017 to the the close of racing on Friday 4 February -the 2 days being Gore (2 February 2017) and Dunedin (4 February 2017).
Facts:
Following the running of race 2 the "Fasttrack Insurance Added Stake Maiden" an Information was filed by Stipendiary Steward Mr M Davidson alleging a breach of rule 638 (1) (d). The Information stated that T Jonker (Crystal Harmony) allowed her mount to shift outwards near the 500m causing Cobblertothestars (R Cuneen) and Spellbello (D Bothamley) to check. Miss Jonker confirmed that she had signed the Information stating that she admitted the breach and that she had a clear understanding of the rule under which she was charged.
Miss Jonker was assisted at the hearing by her employer, Licensed Trainer, Mr. K J Hughes.
Rule 638 (1) (d) states "A rider shall not ride a horse in a manner which the Judicial Committee considers to be ....careless "
Stipendiary Steward Mr McLauglin using the side- on and the film from behind identified Miss Jonker racing 4 back on the rail. He said that at approximtely the 500m Miss Jonker moved her horse out checking Mr Cuneen and in turn Mr Bothamley who were both racing to her outside. He said that Miss Jonker was barely her own length clear at the time of this movement.
Mr Hughes, on behalf of Miss Jonker, said that during the running she was concerned about the horse she was following and was keen to leave its back and had misjudged the space available to do that.
Submissions for Penalty:
Mr Davidson said Miss Jonker is a promising apprentice rider who in a short career has won four races and this was the first time she had appeared before the Stewards. He said he believed this was a low range breach and that a 2 day suspension be considered as penalty.
Miss Jonker and Mr Hughes had no submissions to make on penalty.
Reasons for Penalty:
The Committee has reviewed films of the incident and taken account of the submissions made. The video clearly shows that passing the 500m Miss Jonker moved her horse out when not the required distance clear and did check Mr Cuneen and Mr Bothamley. We agree with Mr Davidson that the level of severity is low.
The JCA's Penalty Guidelines starting point for a South Island rider breaching this rule is 3 riding days and there are no aggravating factors to suggest any increase . However we do give Miss Jonker credit for her admission of the breach and her good record, for which we give a one day discount.
Miss Jonker did not seek a deferment.
