Penalty:
Ms Williams is suspended from race riding from the conclusion of racing on 26 March 2011 until the conclusion of racing on Sunday 10 April 2011. That period will encompass meetings at Wingatui, Banks Peninsula, Riccarton Park and Wingatui.
Charge:
Alleged that K Williams permitted her mount "Heaven Sent" to shift in near the 300m causing tightening to "Hell Yeah" which was checked.
Facts:
Mr Neal requested Mr J McLaughlin, Stipendiary Steward, to demonstrate the incident on the video coverage. Two views were shown, from the head-on camera and from the side-on camera. Mr McLaughlin pointed out how, at the relevant time, Ms Williams was racing about two horse widths off the rail. Mr B Lammas, who was riding "Hell Yeah" could see that there was a rails run avialble to him and commenced to improve into the gap. When his horse was into the gap by at least a neck, Ms Williams drew her whip, the consequence of which was that her mount moved inwards therby interfering with Mr Lammas' run. Ms Williams horse had moved quite significantly after two strokes of the whip and instead of straightening at that point, a third stroke of the whip was administered, which caused "Heaven Sent" to continue its inward movement, checking Mr Lammas mount and depriving "Hell Yeah" of all chances of a rails run. Ms Willams' horse was not its own length and another length clear, at the relevant time.
Ms Williams took corrective action but by the time she did that, the damage was done.
Submissions for Penalty:
Mr Neal told the hearing that Ms Williams has received three suspensions for careless riding in the past twelve months, each of 3 days. He did observe that Ms Williams is a busy South Island rider and that she has had 110 rides since her last suspension. He considered the degree of carelessness to be mid-range. He called for a suspension but did not have a submission on the length of the period of suspension.
Ms Williams said that her mount was not particularly "horse-friendly" and would have contributed to the inward movement when it became aware of the presence of "Hell Yeah" on its inside quarters.
Reasons for Penalty:
The aggravating features of Ms Williams carelessness were the effect on the chances of an improving horse, by depriving it of all chance of a rails run, and the stake for the race, namely $65,000. It was also a "Listed Stakes" race. We cannot overlook that this is also the fourth occasion that Ms Williams has appeared before a Judicial Committee in the last twelve months.
The mitigating features which we are able to take into account, are the fact that she has had 110 rides since her last suspension without incident,and is a busy South Island rider. She has also admitted the charge at the earliest opportunity and was candid in the hearing.
We consider that the starting point for the imposition of penalty is a suspension of five race riding days. However, after taking into account, all factors we feel that we can allow a discount of one day on the starting point, albeit by a narrow margin. Thus, the penalty to be imposed is a suspension of four race riding days.
