Decision:

Mr Johnson having admitted the breach, the charge of careless riding was found proved.  

Penalty:

Mr Johnson’s jockey’s licence was suspended as from after the close of racing on Saturday, 21 June 2014, up to and including Friday, 4 July 2014 – effectively, 5 riding days. The meetings intended to be included in the period of suspension are Wingatui on 26 June, Stratford on 27 June, Hastings on 28 June, Wanganui on 3 July and Ashburton on 4 July 2014.

Facts:

Following the running of Race 7, “Happy 70th Birthday” Corin Murfitt Rating 65, an information was filed by Stipendiary Steward, Mr J M McLaughlin, against Licensed Jockey (Class A), Mr C W Johnson, alleging a breach of Rule 638 (1) (d) in that Mr Johnson “allowed his mount SOMETHINGS BURNING to shift out near the 350 metres when not clear of CONTADOR (T M Direen) which was checked and GOOGLE ME (J L Morris) to be steadied”.

Mr Johnson was present at the hearing of the information and he indicated that he admitted the breach.

Rule 638 provides as follows:

(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

    (d) careless.

Mr McLaughlin had Stipendiary Steward, Mr M Zarb, show video replays of the incident with approximately 350 metres to run. He pointed out SOMETHINGS BURNING, ridden by Mr Johnson, racing towards the outside rail, with CONTADOR on its outside and GOOGLE ME, against the outside fence.

He then pointed out that Mr Johnson gradually let his mount shift outwards and, in doing so, was insufficiently clear of CONTADOR. Mr Zarb pointed out that the riders of CONTADOR and GOOGLE ME had to take hold of their respective mounts. Mr Johnson was not clear and was riding his mount along at all stages.

Mr Johnson said that he had drifted out and did not realise that he had two horses outside him. Just prior to Miss Williams, on CONTADOR, changing ground he got a call from her and “had a look”, but the damage had already been done, he said. 

Submissions for Penalty:

Mr McLaughlin said that Mr Johnson’s record showed a suspension in March of this year, three in November 2013 and one in August 2013. This was just a “lazy manoeuvre” on Mr Johnson’s part in letting his mount drift out, but it was clear that Miss Morris, riding GOOGLE ME, was hard up against the outside rail for some distance. Miss Williams, on CONTADOR, was placed in restricted room and forced to check. He submitted that a term of suspension of 5 days was appropriate. The breach was in the low-to-mid range in the Stewards’ assessment.

Mr Johnson was given the opportunity to contact his agent, Mr Tannahill, after which he reported back to the Committee that he had no engagements during the relevant period. He told the Committee that he did not wish to seek a deferment of any period of suspension.  

Reasons for Penalty:

In determining penalty, the Committee took, as a starting point, a suspension of 5 days as provided in the Penalty Guide. The Committee regarded Mr Johnson as being a South Island and Central Districts rider and calculated the days accordingly. Mr Johnson has had 5 suspensions in the last 12 months and, even allowing for the number of rides he has, this was an aggravating factor. Mr Johnson was entitled to credit for his frank admission of the breach.
