Facts:

Following the running of Race 8, the Coca-Cola Canterbury Gold Cup, an information was filed by Stipendiary Steward Mr A. L. Ray alleging a breach of Rule 636(1)(c) by Licensed Jockey Ms D. S. Johnson in that she failed to ride her horse out to the finish of the race.

The information reads as follows:

“I the above named informant allege that the above named Respondent committed a breach of Rule 636(1)(c) (in that) you failed to fully ride your horse “Woodyeva” out to the finish of the race.”

Rules 636(1)(c) reads as follows:

“(1) A person:

(c) being the Rider of a horse in a Race, must ride his horse out to the end of the Race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared; …”

Ms Johnson had indicated on the information that this breach was admitted, and she confirmed this at the hearing. Ms Johnson also agreed that she understood the charge and the Rule it was brought under.

Submissions for Decision:

Mr Ray gave evidence and used video coverage to show that towards the end of the race Ms Johnson, riding “Woodyeva” (8), was well back in the field. Stake money was payable for the first 10 place getters in this race, with the horses placed 6th to 10th earning stakes of $1500-00. Mr Ray illustrated that with about 30 metres to run Ms Johnson stopped riding her horse and was beaten into 11th place by a very narrow margin by “Crystal Duke” (7).

Ms Johnson did not dispute the facts of this matter.

Reasons for Decision:

As Ms Johnson had admitted the breach it was found to be proved in accordance with Rule 915(1)(d).

Submissions for Penalty:

In relation to penalty Mr Ray advised that Ms Johnson had not previously breached this Rule. There had been a previous similar breach at Riverton recently where a fine of $350-00 had been imposed, and Mr Ray submitted that a fine of the same amount should be imposed in this case.

Ms Johnson had no submissions to make with regard to penalty.

Reasons for Penalty:

In considering an appropriate penalty in this case we took into account that Ms Johnson had admitted the breach and had not breached this Rule previously. Taking into account that this breach was almost identical to the breach at Riverton where a fine of $350-00 had been imposed, we decided that the same fine should be imposed in this case.
