Decision:

The Committee ruled that Race 10 be abandoned.

Facts:

Prior to the running of Race 10, Speight’s Premier, an information requesting a ruling was filed by Chief Stipendiary Steward, Mr R L Neal.

The ruling sought was as follows:

"Due to an electrical storm covering the racecourse safety conditions are compromised and as such seek the abandonment of the race".

Rule 902 provides as follows:

(2) The functions of a Judicial Committee shall be: 

(a) from the commencement of the first proceeding which it commences to deal with on any day of a Race meeting or one hour prior to the starting time of the first Race of that day until after the conclusion of the last proceeding which it commences to deal with on that day, or thirty minutes after the last race run on that day (whichever is the later) to:

(ii) determine any question as to whether that day of racing or any part thereof should be postponed, abandoned or cancelled.

After the horses had left the birdcage for Race 10 and were heading to the 1600 metres starting point, an electrical storm struck the course with thunder and lightning. The Stipendiary Stewards then ordered horses and jockeys to return to the birdcage.

Submissions for Decision:

Mr Neal had convened a meeting in the Judicial Room which was attended by a number of jockeys who were to ride in race 10, the starter, trainers’ representatives, representatives of the Club and the Judicial Committee.

The starter, Ms S P Clark, told the meeting that three lightning bolts had hit the starting gates, one of which had caused the gates to open.

A clear majority of the jockeys stated that they were not prepared to ride in the race while the storm conditions prevailed and it was agreed by all present that it would be dangerous for them to do so.

After a discussion, it was agreed that a decision on whether the race should be run should be delayed for up to 10 minutes to see whether there was by then any improvement in the weather conditions. However, shortly after that, the conditions had not improved and the Stewards put it to the Committee that the running of Race 10 should be abandoned.

The Committee, based on the recommendation of the Stewards and the views expressed by the jockeys, the starter and trainers’ representatives, ruled that Race 10 be abandoned. That decision was made at 6.07pm. The scheduled starting time for the race had been 5.56pm.
