Decision:

As Mr Lockie has admitted the charge against him, it is deemed to be proved.

Penalty:

Taking into account the mitigating factors and the aggravating factor, we allow a discount of two days on the starting point, which therefore means that Mr Lockie will be suspended from race riding for a period of three South Island days, commencing at the conclusion of racing on Sunday 19 December 2010 until the conclusion of racing on Thursday 30 December 2010.

This period of suspension means that Mr Lockie will be unable to ride at meetings at Wingatui, Timaru and Kurow.

Charge:

SWK Lockie, rider of “Gorgeous”, shifted in near the 1,000 metre mark when not clear causing “Mt. Difficulty” (I Khairil) to check.

“Splash” (M Misbah) was also affected.

As a consequence, Mr Lockie was charged with a breach of Rule 638(1)(d).

Rule 638(1)(d) reads as follows:

“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.”

Facts:

The incident was demonstrated on the video coverage by Stipendiary Steward Mr J McLaughlin. He pointed out to the hearing how Mr Lockie moved across when not clear, taking Mr Khairil’s rightful running line. As he crossed over, he was no more than three quarters of a horse length in front. As a consequence, Mr Khairil’s mount was checked and began to over-race as a result of the incident.

Mr Lockie had no comments to make with regard to the incident.

Submissions for Penalty:

Mr Neal informed the hearing that Mr Lockie had been suspended once in the last twelve months. He said that he was struggling to get rides. He is a South Island rider. In Mr Neal’s opinion, the degree of carelessness was mid-range although, he did say that it was an error of judgement on Mr Lockie’s part.

Reasons for Penalty:

In this case a suspension is the most appropriate penalty.

We adopt a five day suspension as a starting point as being appropriate in terms of considering the term of suspension for this careless riding charge. However, that is a starting point, and we are able to take into account a number of mitigating factors which are:

a. Mr Lockie’s early admission of the charge.
b. The degree of carelessness, which was described by Mr Neal as being medium range.
c. Mr Lockie is a South Island rider only.

The aggravating factor is that Mr Lockie received a suspension for careless riding as recently as September 2010.
