Mrs Allpress having admitted the breach, the charge was found proved.

Penalty:

Her Jockey’s Licence (Class A) is suspended for a period from after the conclusion of racing on 23 November 2019, up to and including 4 December 2019 – 7 national riding days.

Facts:

Following the running of Race 5, Barneswood Farm Welcome Stakes (Listed) an information was filed by Chief Stipendiary Steward, Mr J P Oatham, against Licensed Jockey (Class A), Mrs L J Allpress, alleging that Mrs Allpress, as the rider of OHIO SHOWGIRL in the race, “attempted a run between SILENT ZONE (L Callaway) and QUEEN OF THE PROM (S T Collett) when there was insufficient room to do so crowding SILENT ZONE near the 250 metres.”

Mrs Allpress was present at the hearing of the information and she indicated that she admitted the breach.

Rule 638 provides as follows:

(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
    (d) careless.

Mr M R Davidson, had Manager of Stewards, Mr N G McIntyre, show the available video replays of the incident with approximately 250 metres to run.

He pointed out OHIO SHOWGIRL, ridden by Mrs Allpress, racing behind and to the inside of the leader, QUEEN OF THE PROM (S T Collett) as the field turned into the straight. SILENT ZONE, ridden by Mr Callaway, was racing on the inside of OHIO SHOWGIRL.

Shortly thereafter, Mrs Allpress attempted a marginal run between those two other runners. As a result, Mr Callaway’s mount made contact with the running rail and he became unbalanced. There had been no full run for Mrs Allpress’ mount but she positioned herself awkwardly in that run. Miss Collett’s mount did shift in marginally, Mr McIntyre submitted. It was an error of judgement on Mrs Allpress’ part to attempt the shift and put herself in that position.

Mrs Allpress said that she was travelling well on the turn and there was a run starting to appear and, as a senior jockey, she felt she could see it coming. She got inside the heels of Miss Collett’s mount and nine times out of ten a two-year-old would move out, she said. She had called to Miss Collett who had, unfortunately, actually straightened her mount rather than allow it to shift out. Mr Callaway’s mount had been green and had reacted to touching the running rail, Mrs Allpress submitted. 

Submissions for Penalty:

Mr Davidson said that Mrs Allpress has had four suspensions in the last 12 months – at Riccarton in February (low-end, suspended 5 days), March at Woodville (low-end, suspended 6 days), Cambridge in April (suspended 10 days in a Group race) and, finally, at Wanganui on 19 October (suspended 7 days). However, Mr Davidson said, Mrs Allpress has had 772 rides in the last 12 months, making her one of the busiest riders in New Zealand. Her record could be regarded as neutral, he submitted.

Stewards saw the breach as being in the mid-to-low range. Mr Callaway’s mount had touched the running rail and had over-reacted and become very awkward in its stride, making the incident look worse than it was, Mr Davidson said. Mr Davidson submitted that the status of the race as a Listed Race needed to be taken into account as should Mrs Allpress’ admission of the breach.

In mitigation, Mrs Allpress pointed out it was a two-year-old race with inexperienced runners. In particular, Mr Callaway’s mount had overreacted and Miss Collett’s mount had shifted in slightly, she submitted.

She sought a deferment until after racing on next Saturday, 23 November 2019, as she was committed to rides on that date. 

Reasons for Penalty:

The Committee agreed with the assessment of the Stewards that the degree of carelessness, in this case, was in the low-to-mid range. However, it was fortunate for Mrs Allpress that a fall did not result. Accordingly, the Committee has taken a starting point of a 7 national riding days suspension. Having regard to the status of the race (a Listed Race for a stake of $50,000), we have uplifted the starting point to 8 days. We regard her record as being a neutral factor.

Mitigating factors are Mrs Allpress’ admission of the breach and the other factors raised in mitigation – that the race was a two-year-old race and Miss Collett’s mount may have contributed, albeit slightly, by moving in marginally. For those factors, we can allow Mrs Allpress a discount of 1 day from the adjusted starting point.
