As Ms Myers admitted the charge, it is therefore deemed to be proved.

Penalty:

Ms Myers is suspended from race riding from the conclusion of racing on 23rd April 2011 until the conclusion of racing on 30th April 201 (5 days).

Charge:

Alleged that R Myers rider of "So Devine" permitted her mount to shift inwards near the 400 metres causing "Flying Petal" (L Robinson) to be checked and unbalanced.

Facts:

As the field approached the 400 metres mark, Ms Myers was behind "Final Touch" (D Walsh) and "No Choice" (CW Johnson) A gap appeared which was available to Ms Myers. She began to improve but before she could take the oportunity that was available to her the gap narrowed so as to be unavailable. Accordingly Ms Myers shifted ground sharply inwards and in the process caused "Flying Petal" to checked and unbalanced. Ms Myers did not appreciate that "Flying Petal was on her inside flank when she moved, and quite clearly, was not her own length and another length clear when she moved ground inwards. The check to "Flying Petal" was quite significant.

Mr PJ Williams, Licensed Trainer, who accompanied Ms Myers in the hearing, said that Ms Myers had over compensated when the gap between "Final Touch" and "No Choice" narrowed. He said that both of the horse in front moved when under pressure. Ms Myers also said that the incident would not have occurred had the gap not narrowed.

Submissions for Penalty:

Mr Davidson advised the hearing that Ms Myers has been charged twice in the last twelve months with careless riding pursuant to Rule (1)(d), having been suspended for 4 days on each occasion.

He said that the Stipendiary Stewards regarded Ms Myers breach on this occasion to be in the "medium range" and considered that a suspension  of 5 or 6 days should be imposed.

He also said that Ms Myers was a leading apprentice and a promising young rider, riding on a national basis.

Ms Myers said that she had had over 500 rides in the last season.

Ms Myers did not have submissions to make regarding penalty. She accepted that a suspension would be imposed but advised the hearing that she did have engagements at Tauranga on 23rd April 2011 and applied for a deferrment.

Reasons for Penalty:

We delivered the following penalty decision on raceday:

" There is no doubt that Ms Myers over compensated when the gap between the CW Johnson and DM Walsh closed. The result was quite a significant check to to LM Robinson's mount. We accept, however, that Ms Myer's mount was probaly full of running.and you had to go somewhere.

We have given you credit for your early admission of the charge but in imposing penalty, we also have to take into account the status of the race, it being a Listed Stakes race.

We take into account your obvious good record.

The starting point for the penalty is a suspension of 5 days, but because of the aggravating features of your actions and the status of the race,we add two days making the suspension 7 days. Against that, we recognise your good record, and your admission of the chargeand will therefore allow a discount of t 2 days, taking the penalty back to a 5 day suspension.

We grant your application for a deferrment. The period of suspension will commence at the conclusion of racing on Saturday 23rd April 2011 and end at the conclusion of racing on Sturday 30th April. That will encompass meetings at Ellerslie or Riverton (25th) Counties (27th) Marlborough (28th) Matamata (29th) and Te Aroha (30th)"
