As Miss Williams, had admitted the breach, the charge was found proved.

Penalty:

We therefore determined that Miss Williams' Class A Jockeys licence be suspended from the conclusion of racing today 11 February up to and including 18 February 2017. This suspension encompasses the days racing at Canterbury on 16 February and Invercargill on 18 February 2017.

Facts:

Following the running of Race 5, the Tom Burns-You Were A Legend Rating 65, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class A Rider, Miss K Williams, the rider of STONEMASON, alleging careless riding near the 300m, in that she allowed her mount to shift in, crowding and checking BOBBY AL, ridden by Miss S Wynne.

Rule 638(1)(d) reads as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Miss Williams had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. Miss Williams also agreed that she understood the charge and the Rule it was brought under.

Mr McLaughlin, with the assistance of Stipendiary Steward, Mr M Davidson, gave evidence and used video coverage to show that approaching the 300m, STONEMASON, ridden by Miss Williams was racing 4 wide with BOBBY AL, ridden by Miss Wynne in a 3-wide position inside Miss Williams. Mr McLaughlin stated that STONEMASON was laying in approaching the 300m and when Miss Williams drew the whip and began to ride the horse out, she allowed her mount to shift inwards into the racing line of BOBBY AL and as a consequence, Miss Wynne had to check. Mr McLaughlin stated that Miss Williams was only a length clear when shifting into Miss Wynne's racing line. He submitted that the breach was low level.

Miss Williams stated that STONEMASON was hanging in at the time and that she had not realised that she had Miss Wynne on her inner. She also stated that once she knew Miss Wynne was on her inner she took corrective action albeit too late. She stated that she had made an error of judgement.

Submissions for Penalty:

Mr McLaughlin stated that Miss Williams’ penalty record was a remarkable one with only one breach of this rule over the previous 12 months at Cromwell on 27 November 2016 where she received a 3-day suspension for a mid-range breach. He said that prior to that Miss Williams had not breached this rule since 2014. Mr McLaughlin said that the JCA Penalty Guide recommended a starting point of a 3-day suspension for a South Island jockey and submitted that after taking Miss Williams ready admission of the breach, her good record and the low level of the breach into consideration, that a 2-day suspension be considered as penalty.

Miss Williams asked that her good record and admission of the breach be taken into consideration when considering penalty. She also stated that she was not seeking a deferment and requested any suspension begin as soon as possible.

Reasons for Penalty:

In determining penalty, the Committee took into consideration Miss Williams' frank admission of the breach, her overall good record and the level of carelessness which we also assessed as low. In adopting the JCA Penalty Guide starting point of a 3 day suspension for a South Island rider we were able to afford Miss Williams a discount of 1 day for her frank admission of the breach, her good record and the low level of the breach. We therefore determined that a 2-day suspension was an appropriate penalty in this case.
