Facts:
Following the running of Race 7, the McMillan Equine Maiden, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class B Rider, Mr B Murray, alleging careless riding in that he angled his mount outwards when not sufficiently clear crowding SEKATIA near the 400m.
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Murray had indicated on the Information that this breach of the Rules was admitted, which he confirmed at the hearing. Mr Murray also agreed that he understood the charge and the Rule it was brought under. Mr D Walsh, NZTR Apprentice Jockey Mentor, assisted Mr Murray at the hearing.
Mr McLaughlin, with the assistance of Chief Stipendiary Steward, Mr J Oatham, gave evidence and used video coverage to show that nearing the 400m, BOYSLIGHTUP, ridden by Mr Murray, was racing 3 wide and midfield on the inside of SEKATIA, ridden by Mr G Jogoo and ITSTOLATE, ridden by Mr J Parkes. Mr Oatham stated that rounding the turn, Mr Murray was held up and did not have a run available to him. He showed in the films that Mr Murray then opted to direct his mount outwards with vigour, when clearly not clear of Mr Jogoo who was crowded and buffeted out onto Mr Parkes' mount, ITSTOLATE. Mr Oatham stated that Mr Murray has forced a run and was only ½ a length ahead of Mr Jogoo when shifting out.
Mr Walsh stated that it was obvious Mr Murray got impatient and should have sat and waited for an opportunity. He said that Mr Murray had tried to straighten his mount once contact was made but because his horse was unbalanced and lying into Mr Jogoo’s mount, he could do no more. He said he should have waited for a further 5 to 6 strides.
Submissions for Penalty:
Mr McLaughlin stated that Mr Murray’s record showed he had received an 8 National day suspension on the first day of the meeting being 4 August which with deferment starts after racing on 11 August. He stated that this breach was mid-range and rather a crude move by Mr Murray. At no point, he said, did Mr Murray stop riding his mount. Mr McLaughlin submitted that a term of suspension no less than 9 National days be considered as penalty in this case.
Mr Walsh stated that Mr Murray has had numerous suspensions recently and can’t seem to get into the groove of riding long enough to get things flowing well. He also stated that the Stewards' submission for a 9 National day suspension was fair.

The JCA Penalty Guide for a mid-range breach of this rule is an 8 National day suspension. The Committee assessed this breach as above mid-range and therefore adopted a 9 National day starting point. The aggravating factor was Mr Murray’s record which showed a breach only 4 days previous which warranted an uplift in penalty which we set at 2 days. We were however able to afford Mr Murray a discount for his frank admission of the breach which we set at 1 day. We therefore determined that a 10 National-day suspension was an appropriate penalty in this case.
