Decision:

Following the running of Race 7, the FMG 135th Grand National Steeplechase Handicap, Chief Stipendiary Steward Mr R. Sanders filed an information pursuant to Rule 530(2)(b) alleging Jockey P. J. N. Turner, the rider of “Mikemeendaad” (3), used his whip excessively when out of contention.
 



Following the running of Race 7, the FMG 135th Grand National Steeplechase Handicap, Chief Stipendiary Steward Mr R. Sanders filed an information pursuant to Rule 530(2)(b) alleging Jockey P. J. N. Turner, the rider of “Mikemeendaad” (3), used his whip excessively when out of contention.
 
Mr Turner had indicated on the Information that he admitted this breach of the Rules and he confirmed this at the hearing.  Mr Turner also agreed that he understood the Rule and the nature of the charge.

Mr Sanders used video coverage of the incident to show that after jumping the last fence in second to last place, Mr Turner had used his whip on numerous occasions when his horse was clearly out of contention.  Mr Turner had no comment to make as to the facts of this matter.

Penalty:

In relation to penalty Mr Sanders advised that Mr Turner had previously breached this Rule on 1 July 2009 when he had been fined the sum of $350-00.  It was also relevant that the race was a Prestige Jumping Race.  Mr Sanders recommended a fine of no less than $500-00. Mr Turner said that he would prefer a fine to a suspension. We adjourned to consider penalty.

We took into account Mr Turner’s guilty plea.  On the other hand Mr Turner has a recent previous conviction under this Rule, and this was a Prestige Jumping Race.  Taking these matters into account we decided that a fine of $500-00 was appropriate in this case.  On resuming the hearing the parties were advised that Mr Turner was fined the sum of $500-00.
