Decision:

Following the running of Race 6, the Gladsome Lodge Maiden, Chief Stipendiary Steward Mr R. Sanders filed an information pursuant to Rule 871(1)(d) alleging Apprentice Jockey M. Tanaka rode carelessly.

Following the running of Race 6, the Gladsome Lodge Maiden, Chief Stipendiary Steward Mr R. Sanders filed an information pursuant to Rule 871(1)(d) alleging Apprentice Jockey M. Tanaka rode carelessly.

Mr Tanaka was assisted at this hearing by Licensed Jockey Mr R. J. Hannam. Mr Tanaka had indicated on the information that he admitted this breach of the Rules, and he confirmed this at the hearing.  Mr Tanaka also agreed that he understood the Rule and the nature of the charge.

Mr Sanders illustrated this incident by means of video coverage, and showed that near the 1300 metre mark Mr Tanaka, the rider of “Zak’s Choice”, had allowed his mount to shift in taking “Dagitap” (O. Bosson) inwards across “Old Boys” (J. Todd) which had to be checked.  Mr Tanaka did not dispute the facts of this matter.

Penalty:

In relation to penalty Mr Sanders advised that Mr Tanaka had an excellent record with no breaches of this Rule within the last 12 months.  The race was a $15,000-00 maiden on a Premier day.  As Mr Tanaka had admitted the breach a suspension of a minimum of 4 days was recommended.

Mr Tanaka said that he would like his suspension to start immediately, but had no other submissions to make.

In coming to a decision on an appropriate penalty we took into account Mr Tanaka’s admission of the breach and his excellent record.  We were satisfied that a 4 day suspension was appropriate in this case.  The parties were therefore advised that Mr Tanaka was suspended from the completion of racing on 8 August 2009 until after the completion of racing on 15 August 2009, which is 4 days.
