Decision: Stipendiary Steward Mr S. C. Ching has asked the Committee for a ruling as to whether ?Chief Ebony? (9) should be scratched following the running of Race 8 in which that horse finished in 3rd place. REQUEST FOR A RULING: Stipendiary Steward Mr S. C. Ching has asked the Committee for a ruling as to whether ?Chief Ebony? (9) should be scratched following the running of Race 8 in which that horse finished in 3rd place. The Information reads as follows. ?I the above named informant hereby apply to the judicial committee to seek a ruling on the following matters: in that the third placed horse Chief Ebony ridden by J. Bates failed to draw the proper weight of 56.5kg by 1.5kg, be disqualified as stated in the above Rule.? Rule 857(3) provides as follows. ?If on being weighed in, a rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5kg and if the allowance is not sufficient to enable the proper weight to be drawn the horse shall be disqualified for the race?. Mr Ching gave evidence along the lines of the above request. He said that the Rule was quite clear and that the horse must be disqualified. Mrs T. J. Stokes, the co-trainer of Chief Ebony, also attended this hearing. Mrs Stokes agreed that she understood the effect of the Rule and that her horse had to be disqualified. Mrs Stokes also said that she was aware of how this situation had arisen, and this is dealt with in our decision relating to the subsequent charge against Mrs Stokes. We were satisfied that Chief Ebony should be disqualified and a decision was made accordingly. The amended places are as follows. 1st ? Bravo Star (19) 2nd ? Southern Courage (16) 3rd ?
