Following the running of Race 8, the Farringtons Tavern Rating 76, Stipendiary Steward Mr S. C. Ching laid an information against Mrs T. J. Stokes the co-trainer of ?Chief Ebony? alleging a breach o0f Rule 858(4). The charge reads as follows.

?I the above named informant allege that the abovenamed Defendant committed a breach of Rule 858(4) in that T. Stokes (Trainer) of Chief Ebony omitted putting the lead bag on when saddling up prior to the running of this event. On return to the scales when running third was found to be 1.5kg below the weigh out weight.?
----
Rule 858(4) provides as follows.
----
?Every Owner, Trainer or other person for the time being in charge of a horse who does or permits any wrongful act or omission with respect to weight or weighing or who, after the horse's rider has weighed out and before the horse races, removes or adds any article of wearing apparel or riding or other gear with which the rider did or did not weigh out as the case may be, commits a breach of these rules.?

Mrs Stokes had indicated on the Information that she admitted this breach of
--the Rules and she confirmed this at the hearing.

Mr Ching gave evidence that Mrs Stokes was the co-trainer of Chief Ebony which finished third in the race. When weighing out Jockey J. Bates needed 1.5kg of additional weight to make the horses carded weight of 56.5kg. On returning to scale and weighing in it was found that the lead bag was missing and consequently Mr Bates weighed in 1.5kg light. As a result Chief Ebony was disqualified from the race.

Mrs T. J. Stokes, the co-trainer of Chief Ebony, gave evidence that she had taken the saddle and the lead bag to the saddling area where she had put them on a rail. There were strong winds at that time and the saddle had blown off the rail. Mrs Stokes said that she did not realise at that time that the lead bag had remained on the rail. When Chief Ebony weighed in light she immediately realised what had happened.

Penalty: In relation to penalty Mr Ching advised that Mrs Stokes has an exemplary record as a Trainer. Mr Ching also said that the only previous conviction for a breach of this Rule that he was aware of had resulted in a fine of $1000-00, and that this would be an appropriate fine in this case..

Mrs Stokes was asked for her submissions as to penalty, but she had no submissions to make.

We also looked at previous penalties for a breach of this Rule and we were satisfied that a fine of $1000-00 was appropriate. Mrs Stokes was fined the amount of $1000-00.
