Miss Jonker has admitted the breach and, accordingly, the charge is found proved.

Penalty:

Miss Jonker is fined the sum of $300.

Facts:

Information No. A11460 was filed by Stipendiary Steward, Mr J M McLaughlin, against Licensed Apprentice Jockey (Class B), Miss T Jonker, alleging that Miss Jonker as the rider of MEARA MARY in the race, “could not make the contract weight for MEARA MARY and was replaced”.

Miss Jonker was present at the hearing of the information and she indicated that she understood the charge and that she admitted the breach.

Rule 330 provides as follows:

(3) A Rider shall not:
(c) fail to ride a horse at the weight at which it is handicapped to carry.

Mr McLaughlin said that Miss Jonker had come to him on raceday morning and advised that she had no chance of making the carded weight for MEARA MARY. Her weight was 58.5 and the carded weight for MEARY MARY is 56.5. She was replaced for the ride on the horse (by Apprentice Jockey, S Toolooa).

Miss Jonker said she has had a battle with her weight. She has been on holiday but felt she could get her weight down. She has made herself ill recently trying to get her weight down and she does not wish to repeat this, she said. She is contemplating taking a break from riding because she cannot get her weight down.

Submissions for Penalty:

Mr McLaughlin outlined Miss Jonker’s record under the rule. On 19 June last, she received a fine of $100 under the Minor Infringement system and, on 13 July last, was fined $200 under that system.

Stewards believe that the penalty on this occasion should be a fine, Mr McLaughlin said, and that fine should be around the $300 mark, since Miss Jonker was contemplating putting her apprenticeship on hold.

Reasons for Penalty:

The Committee was satisfied that, in the circumstances, a fine was the appropriate penalty and that the amount of that fine should not be unduly punitive, given the struggle that Miss Jonker has been having with her weight. We commend her for contemplating a break away from riding to attempt to address her ongoing weight issues. The Committee wishes her luck in this regard and hopes that she will be able to overcome those issues and continue her very promising riding career.

It is, however, appropriate that there be an uplift of penalty from the two recent breaches of $100 and $200, the present breach being Miss Jonker’s third in less than 3 months.
