Penalty:
The Committee granted Mr Johnson’s application for a deferment, it being satisfied that Mr Johnson has riding engagements during the next seven day period, including on the 3rd day of the Canterbury meeting on 14th November.
Mr Johnson’s Jockey’s Licence (Class A) was suspended for a period from after the conclusion of racing on Saturday, 14th November 2015, up to and including Saturday, 28th November 2015 – 4 riding days. The meetings intended to be encompassed by the period of suspension are Southland RC on 19th November, Rangitikei RC on 21st November, Levin RC or Winton JC on 27th November and Wanganui JC on 28th November.

Following the running of Race 9, The Paint Lab Hornby Premier, an information was filed by Co-Chief Stipendiary Steward, Mr R L Neal, against Licensed Jockey (Class A), Mr C W Johnson, alleging that Mr Johnson, as the rider of QUERER in the race, “permitted his mount to shift inwards near the 800 metres and checked MELS EVIE (J L Morris) and CARAMAC (R J Myers)”.
Mr Johnson was present at the hearing of the information and he indicated that he admitted the breach.
Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Mr Neal had Stipendiary Steward, Mr M R Davidson, show video replays of the incident, approximately 300 metres after the start of the 1100 metres race. He pointed out QUERER, ridden by Mr Johnson, racing in 3rd position and 3-wide on the outside and just ahead of MELS EVIE (J L Morris) with CARAMAC (R J Myers) on the inside of that runner. He then pointed out Mr Johnson look to his inside on two occasions before shifting in and crowding the two inside runners, with CARAMAC making contact with the running rail. Mr Davidson submitted that there was not room for three runners.
Mr Neal submitted that the video replay was self-explanatory.
Mr Johnson was given the opportunity to comment on the incident but declined to do so.
Submissions for Penalty:
Mr Neal told the Committee that Mr Johnson’s riding record disclosed that, in the last 12 months, Mr Johnson had received two suspensions for careless riding – the most recent was in August at Canterbury where he received 4 days and, prior to that, he had been suspended for 4 days at Otaki in February. His record was “a reasonably good one”, Mr Neal submitted, given that Mr Johnson is a “busy rider”.
Mr Neal said that, looking at Mr Johnson’s record back to July 2015, it demonstrated that he had ridden at Hawkes Bay on the three days of the Spring Carnival there (29 August, 19 September and 3 October) and had also ridden at a Levin meeting at the end of July.
With regard to this particular breach, Mr Neal submitted that it was clear that Mr Johnson had shifted his mount inwards across the heels of MADAME JAMAI (M Cameron) and, in doing so, had crowded MELS EVIE onto CARAMAC, the latter receiving a “pretty substantial check” and had, effectively, lost its running. CARAMAC had made contact with the running rail and had not recovered, he submitted.
Mr Neal referred to the Penalty Guide. He acknowledged that Mr Johnson had admitted the breach and added that Stewards considered his record to be a reasonable one.
Mr Johnson told the Committee that he wished to seek a 7-days deferment of any suspension.
Mr Neal said that Mr Johnson tended to ride at major North Island meetings, particularly in the Central Districts. His record shows that he does not ride habitually in the North Island. Mr Neal submitted that meetings in the Northern Region, along with mid-week Central District meetings, should be excluded from any consideration in fixing the term of suspension. A discussion followed in which forthcoming Central Districts and South Island meetings were looked at.
Reasons for Penalty:
In determining penalty, the Committee took, as a starting point, the 5 days’ suspension as suggested in the Penalty Guide. The aggravating factor in this case was that the carelessness was, in the Committee’s view, in the mid-high range as Mr Johnson had elected to shift inwards and closer to the running rail despite being aware of the presence of the two runners on his inside. He was certainly not his own length and another length clear when he shifted in. The Committee decided that this factor warranted an uplift in the starting point to 6 days.
Mitigating factors were Mr Johnson’s admission of the breach and his race riding record, which the Committee considered to be good having regard to the number of rides that Mr Johnson has. We considered that these factors warranted a discount of 2 days.
In deciding on the actual meetings for which Mr Johnson should be suspended, the Committee was satisfied that it was quite likely that Mr Johnson, who has a North Island agent, would have been likely to secure rides at the Central Districts meetings at Rangitikei on Saturday, 21 November, and at Wanganui on Saturday, 28 November. Both of those meetings are categorised as “Feature Meetings” and the Wanganui Cup on 28 November is a $50,000 race.
