DECISION & REASON
--Information 0094 alleging a breach of the Rules of Racing, Rule 871 (1) (d) in that C Spittles permitted her mount FORESURE to shift out near the 300m when not clear of WINDVALE JO ridden by C W Johnson, who had to be checked, was lodged by Mr C George, Chief Stipendiary Steward.
--Ms Centane Spittles, as a result of an incident near the 300m mark, was charged with careless riding pursuant to Rule 871 (1) (d) of the Rules of Racing. It was alleged "that she permitted her mount FORESURE to shift out when not clear of WINDVALE JO ridden by C W Johnson, who had to be checked."
--Ms Spittles admitted the charge, which is therefore deemed to be proved.
--Chief Stipendiary Steward Mr C George demonstrated the incident on the video coverage. The incident clearly demonstrated that Ms Spittles allowed her mount to shift out into the line of C W Johnson's running. There was no need for her outward movement as she had clear running room available to her. Furthermore, she was not sufficiently clear in terms of the Rules of Racing.
--Mr J Parsons, Ms Spittles' employer, told the hearing that the horse was having its first run in 15 months and seemingly rolled out when it was coming to the end of its run.
--PENALTY
--Mr George told the hearing that Ms Spittles has been suspended four times during the current racing season for breaches of Rule 871 (1) (d) and submitted that a suspension of between two and five days ought to be imposed. In response, Mr Parsons urged the Committee to consider that there is little racing in the South Island at this time of the year and that we should take that into account when setting the penalty. It was confirmed to the hearing that Ms Spittles only rides in the South Island.
--The incident was, in our opinion, in the middle of the range in terms of the degree of seriousness. Ms Spittles was insufficiently clear of C W Johnson and inconvenienced him. However, the aggravating factor is that this is the fifth occasion that Ms Spittles has faced a careless riding charge in this current racing season.
--In mitigation, Ms Spittles must be given credit for her immediate guilty plea to the charge.
--A suspension is the appropriate penalty, but on this occasion there will also be a fine to reflect the aggravating factors that we have mentioned.
--Ms Spittles will therefore be suspended from the conclusion of racing today, 7th June 2007, until the conclusion of racing on 30th June 2007, that is to say three South Island riding days, at Timaru on 15th June, Canterbury Racing on 24th June and Oamaru on 30th June. In addition, she will be fined $250.
