DECISION:
----Ms K Williams has been charged pursuant to Rule 304 of the Rules of Racing, with misconduct. It is alleged that she used offensive and foul language at fellow rider, Miss L Parker, following the running of Race 5.
----The fact situation is that after Race 5 Mr M Humphreys, Assistant Stipendiary Steward, went to the female jockeys' room to return a surcingle to Miss Parker. When Miss Parker presented at the door she was in tears. She informed Mr Humphreys that she had been roundly abused in foul terms by Miss Williams. Miss Parker told us that as she returned to the jockeys' room that Miss Williams told her that she was "f?..g useless" that she should retire, and that "you give me the shits" or words to that effect. It seems that Miss Williams was highly critical of the manner in which Miss Parker had carried out her ride. The abuse apparently went on for about a minute.
----Miss Parker's employer, Mr M Pitman, spoke in support and told us that Miss Parker had been subjected to abuse on several other occasions by Miss Williams. The relationship between Miss Parker and Miss Williams was of concern to him. He felt that Miss Williams, as the Master of the Apprentice School, should not behave in the manner that she did. Mr Pitman also told us that Miss Parker had ridden in accordance with her instructions to her.
----Mr Ching confirmed that there was nothing untoward about Miss Parker's ride in its early stages, which was what Miss Williams was complaining off. Mr N McCutcheon, the Chief Stipendiary Steward, confirmed also, that he believed there was nothing wrong with Miss Parker's ride. Miss Williams, in reply, acknowledged that she had spoken to Miss Parker in the manner complained off, she was critical of Miss Parker going to the lead at the point that she did and not easing the pace. She said that she would have stayed in behind or in jockey's parlance, she "would have taken the sit".
----In answer to a question from the chair, Miss Williams acknowledged that there was a difficulty in her relationship with Miss Parker and conceded that she spoke to Miss Parker in a manner that she would not normally use, if being critical of another apprentice's ride.
----In determining penalty, it should be noted that we place little, if not no emphasis, on the way in which Miss Parker rode. We have not viewed the incident complained of by Miss Williams as this is irrelevant to the case before us. The issue we must address is Miss Williams' conduct towards Miss Parker and the language complained of. We do not expect jockeys to use the language of saints if they are upset with the actions of another jockey, but we do not expect abusive conduct and language which this clearly was.
----In setting the penalty, we cannot take into account the previous incidents alleged. We do note, however, that Miss Williams has been warned about such conduct towards Miss Parker by Mr Ching in the past.
----Miss Williams' language and attitude towards Miss Parker is unbecoming of a senior jockey, and in particular, unbecoming of her position as Master of the Apprentice School.
----PENALTY
----A fine is the appropriate penalty. In setting the fine, we take into account Miss Williams' previous good record, her early admission of guilt and the fact that she has not tried to minimise her conduct.
----A fine of $500 is set.
