Information No. 7151 was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr D R Bothamley, alleging that Mr Bothamley “permitted himself to be engaged for LOLA COUP (in Race 7, Taggart Earthmoving Maiden) when he could not make the contract weight”.

Mr Bothamley was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.

Rule 520 provides as follows:

--

(4)     Every rider commits a breach of these Rules who:

--

(c)          wilfully or without reasonable cause permits himself to be engaged to ride a horse when he knows or ought to know that he will not be able to ride the horse at the weight which it is handicapped to carry or such other weight at which he agrees to ride the horse.

Mr Ching informed the Committee that Mr Bothamley had approached the Stewards prior to 10.00am on raceday to advise that he was not able to make the weight for LOLA COUP, which he was engaged to ride in Race 7, and was 1kg overweight. He had been replaced on the horse by R J Bishop. LOLA COUP was carded to carry 55kg in the Race. He said that Mr Bothamley had been having difficulty with his weight but had not breached the Rule within the last 12 months. He recommended a fine of between $150 and $250.

Mr Bothamley said the he had been riding at 54.5-55kg quite comfortably recently but had had a “bad week” and his weight had got out of hand. He said that he had a “fair idea” the previous evening that he would have difficulty making the weight of 55kg for LOLA COUP.

In determining penalty, the Committee took into account Mr Bothamley’s admission of the breach and his previous good record, despite the weight problems he had been having. The Committee also gave Mr Bothamley credit for informing the Stipendiary Stewards early on raceday that he was unable to make the weight on LOLA COUP.

Having regard to those matters, the Committee fined Mr Bothamley the sum of $150.
