Following the running of Race 8, CW Johnson, L:icensed Jockey, was charged with careless riding pursuant to Rule 871(d). The Information alleged:

"Over the concluding stages of Race 8, CW Johnson, the rider of "Delbrae" allowed his mount to move outwards and make contact with "Eye of Horus" (R Hannam) on two occasions."

The informant's case

Mr Ching referred us to the incident of which he complained using the video coverage from the side on and head on cameras. It should be noted that this committee had already viewed the film at some length in the protest hearing.

What Mr Ching pointed out specifically to us from the video coverage was the fact that when "Delbrae" was making the outward movement which led to the interference with "Eye of Horus" on two occasions, that on each occasion, Mr Johnson carried on using the whip. The Committee observe that Mr Johnson uses his whip with his left hand which was clearly instrumental in causing Mr Johnson's mount to move outwards. Mr Ching submitted that Mr Johnson had a duty to keep his horse on a straight line and to ensure that it was ridden safely. It was his submission that on each occasion, Mr Johnson was too late in taking the appropriate corrective action.

The defendant's case

Mr Johnson stated that he acknowledged the outward movement but said that on each occasion, he was caught by surprise. He thought that he had taken corrective action in time. He also said that he had lost control of the inside rein on the second time that the horse moved outwards.

Decision

After considering all of the evidence, and after studying the video coverage, we are satisfied that there is sufficient evidence to satisfy us that Mr Johnson rode carelessly. We agree that a jockey has a duty to maintain a horse on a proper line, and it was readily apparent that Mr Johnson took corrective action too late on each occasion. Had he taken corrective action two to three strides earlier, it is likely that the interference to "Eye of Horus" would not have occurred.

Therefore, we have no difficulty in concluding that the charge has been proved accordingly.

Submissions on penalty

Mr Ching told us that Mr Johnson has been charged with careless riding on two occasions in the last year, and that on 23 January 2006 he received a six day suspension which was reduced to four days on appeal and on 11 January 2006 he was fined $500 and given a two day suspension in addition.

Mr Johnson did not have any submissions to make on penalty.

Penalty decision

This was a Group 3 race with a $100,000 stake. Mr Johnson's mount was relegated as a result of his careless riding and the interference which was a consequence of it.

These are matters that we are obliged to take into account in terms of Rule 1122(2) of the Rules of Racing.

Thus, we are duty bound to impose a suspension.

--

Mr Johnson is therefore suspended from race riding from the close of racing on Wednesday 9th August 2006 until the conclusion of racing on Saturday 3rd September 2006

On the basis of what we have been informed by Mr Johnson as to where he would be riding in that period, the suspension is a six day suspension.
