THE FACTS
--Just prior to the running of Race 6 of the Canterbury Jockey Club's meeting on 30 November 2007, the attention of the Stipendiary Steward was drawn to the fact that Mr Troy Harris, Apprentice Jockey, was three quarters of a kilogram over the weight at which he had allowed himself to be engaged for the ride on MARUIA SPRINGS.
--Mr Harris pleaded guilty, and the charge is therefore deemed to be proved.
--Mr Ching explained that Assistant Stipendiary Steward, Mr J McLaughlin, had alerted him to the fact that Mr Harris was overweight following a check with Mr K Berry, Clerk of the Scales.
--A meeting was convened with the trainer of MARUIA SPRINGS, Mr P Williams, but it transpired that no other apprentice rider was available at such short notice, and that Mr Williams was reluctant to change the rider in any event. Thus Mr Ching, with some reluctance, allowed Mr Harris to ride in the race using his discretion under Rule 851(1). He said that normally a rider would be replaced in such a circumstance. In explanation Mr Harris said that he did not know that he had to get permission. He said that he was having a weight problem, and had just returned from holiday when his weight got away on him. He thought the Clerk of the Scales should have done more than he did in the circumstances.
--Mr Ching told the hearing that Mr Harris has been charged four times during the past twelve months for a breach of this rule, and was fined $400 on 27 October 2007, $750 on 14 July 2007, $250 on 21 April 2007, and $200 on 13 January 2007.
--Mr Harris disputed the allegation that he had been fined on 21 April 2007 at Tauranga.
--Whatever the situation, this is either the fourth or fifth time that Mr Harris has been charged pursuant to this rule during the past twelve months. We have to say that Mr Harris's explanation that he did not know that he had to obtain permission in terms of Rule 851(1) is somewhat hard to accept. Mr Harris has only some six months to complete his apprenticeship, and for him to say that he did not know the rule is a feeble excuse.
--We acknowledge, as a minor mitigating feature, that perhaps there is a minor fault in the system, in that the Clerk of the Scales should have been more forceful about drawing Mr Harris's attention to the fact that he was well over the carded weight, and that it would be necessary for him to obtain permission before riding. Nonetheless, the responsibility stills rests with the jockey, when he or she presents at the weigh out, and is found to be overweight, to notify the Stipendiary Stewards.
--PENALTY DECISION
--In this case, whilst a suspension would have been well and truly justified, we are prepared, with some reluctance, to impose a fine. However, the fine will need to reflect Mr Harris's somewhat cavalier and rather underhand approach to this matter and it must also have a significant deterrent effect.
--Mr Harris will be fined the sum of $1200.
