Following the running of Race 4, "Robbies Bar & Bistro - 665 Pages Road New Brighton", Ms L K Young, the rider of AL FAROUK, weighed in 0.5 kg over her weigh-out weight of 55.25 kg.
| -- DECISION AND REASON --Following the running of Race 4, "Robbies Bar & Bistro - 665 Pages Road New Brighton", Ms L K Young, the rider of AL FAROUK, weighed in 0.5 kg over her weigh-out weight of 55.25 kg. AL FAROUK finished 4th. The margin between 3rd and 4th was 1? lengths. --Mr Ching called Mr K Berry, the Clerk of the Scales, who said that Ms Young weighed out at 55.25 kg and that she had brought, amongst other things, her saddle and red pad with her when she weighed out. She had a blue towel with her which did not form part of the gear she weighed out with. He observed her add the towel to her gear as she left the weighing area. Mr Berry confirmed that the scales were correctly calibrated. --Ms Young did not challenge Mr Berry's evidence. She said in her defence that, included in her gear was a blue towel which was under the red pad. She did say that the trainer of the horse had asked her to use a bigger saddle because her horse was a first starter ? but that saddle caused her to weigh heavy, so she changed to a lighter saddle. She said she had two towels which are the same colour and that she believed that Mr Berry may not have seen the towel she weighed out with. She attributed her oversight on weigh-in to the horse's sweat being absorbed into the towel and girth cover. --After giving consideration to the evidence, we have to say that we prefer the evidence of Mr Berry. That finding on our part is not to say that Ms Young has lied to the hearing. We imply that she is mistaken in her evidence. She posed the question, "Why would I do it?" and that supports our finding that she was mistaken in her evidence. --We therefore find the charge proved. --Penalty --We have found that Ms Young made a mistake with her towel ? perhaps it could be regarded as a human error on a busy race day. The breach should be regarded as being at the lower end of the scale. We do not think that the racing public or the horse's connections were unduly affected by the breach. --We impose a fine of $175. ----
