An information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Trainer, Mr L J Morris, alleging a breach of Rule 867 (3) (c) in that Mr Morris, as the trainer of MISS UNICORN in Race 6, Robbie's Bar & Bistro Kaikoura Maiden, presented that horse with faulty plates prior to the running of the event.

An information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Trainer, Mr

L J Morris, alleging a breach of Rule 867 (3) (c) in that Mr Morris, as the trainer of MISS UNICORN in Race 6, Robbie's Bar & Bistro Kaikoura Maiden, presented that horse with faulty plates prior to the running of the event.

Rule 867 (3) (c) provides as follows:

--

Every person commits a breach of these Rules who:

--

(c) starts or attempts to start in any race a horse wearing shoes or wearing excessively worn

--

or otherwise faulty or defective plates.

--

Mr Morris was present at the hearing of the information and admitted the breach. The charge was, accordingly, found to be proved and the hearing proceeded in relation to penalty.

Mr Ching told the Committee that he had been alerted by Mr M G Humphries, Assistant Stipendiary Steward that MISS UNICORN had a problem with plates and would not pass inspection. Mr Ching said that he went to the stalls where the blacksmith was repairing the front plates of the horse. The rear plates were removed and Mr Ching gave permission for the horse to start without rear plates. Mr Ching produced the faulty plates ? one was broken in half and the other would not be fit to race in according to the plating inspector. The horse started in the race without hind plates on.

Mr Ching informed the Committee that Mr Morris had a very good record as far as the Stipendiary Stewards were concerned. Mr Morris had never been before the Stipendiary Stewards since he started training. However, Mr Ching said such breaches could not go "unchecked" and he suggested that a fine would be appropriate in the circumstances.

Mr Morris freely admitted the breach. He explained that he got the blacksmith every Monday. MISS UNICORN had raced at Riccarton on 15 May and had therefore not been checked on that Monday. He further explained that his head girl had been away for a week and he, himself, had not been there last Monday, 22 May. He said that, if he had had any idea that there was a problem with the mare's plates, she would have been plated on the morning of the races. It was an "oversight" and there was no intent on his part, Mr Morris said.

The Committee took into account Mr Morris's admission of the breach and his very good record as referred to by Mr Ching. The Committee also noted that a fine of $200 had been imposed for a breach of the same Rule at the meeting of Westland RC in March of 2005.

Mr Morris was fined the sum of $200.
