As a result of Ms A Mundy's use of the whip in Race 7 at the Canterbury Jockey Club's meeting on Friday 27 June 2008, she was charged with a breach of Rule 530 (2)(b). As a result of Ms A Mundy's use of the whip in Race 7 at the Canterbury Jockey Club's meeting on Friday 27 June 2008, she was charged with a breach of Rule 530 (2)(b). It was alleged by Stipendiary Steward Mr M Davidson that Ms Mundy, being the rider of NEW YORKER, used her whip in an excessive manner between the 350 metre and 200 metre marks.
--Stipendiary Steward Mr M Davidson demonstrated the incident on the side on camera, and it was apparent that Ms Mundy used her whip continuously for some 14 to 17 times from the 350 metre mark to the 200 metre mark, which he said was clearly in breach of the guidelines.
--Ms Mundy has no comment to make with regard to her use of the whip, but in response to a question from the Chairman, agreed that she did not hit the horse with any particular vigour.
--Mr M Pitman, Ms Mundy's employer, asked the Judicial Committee to take into account the fact that Ms Mundy was trying hard to get her 100th winner as an apprentice, and asked that she be given credit for her good record, having served four years as an apprentice without an appearance before a Judicial Committee.
--Mr Davidson confirmed that Ms Mundy did have a "clean record" and asked that she also be given credit for her early guilty plea. Mr Davidson said that the degree of seriousness of the offence, in his opinion, was from the low to mid end of the scale.
--PENALTY DECISION
--We have considered the submissions of Mr Davidson and Mr Pitman. We agree that it was not the worst case of excessive use of the whip that we, as a Judicial Committee, have seen.
--However, notwithstanding that the breach may have been at the lower end of the scale, the fact of the matter is that a jockey must, at all times, use the whip in accordance with the guidelines which are well known to all jockeys. Animal welfare is critically monitored by a lot of armchair viewers, and no-one wants to see racing brought into disrepute.
--We have given Ms Mundy credit for her excellent record to date, and agree that a fine is appropriate. The fine is $150.
