Following the running of Race 4 at the Canterbury Jockey Club on Friday 27 June 2008, a protest was lodged by Mr A Lloyd, the trainer of REPUBLICAN STAR which was placed second by the Judge, against Ms G Goble, the trainer of STEP WISELY, placed first by the Judge.

It was alleged that STEP WISELY interfered with the chances of REPUBLICAN STAR over the concluding stages of the race.

Mr David Lloyd spoke on behalf of the connections of REPUBLICAN STAR. He alleged that STEP WISELY interfered with REPUBLICAN STAR on three occasions in the home straight, and said that, in his opinion, it cost REPUBLICAN STAR  "at least a neck". Having regard to the margin at the finishing post of a nose, Mr Lloyd that that this was sufficient to warrant a change in placing. He demonstrated the three alleged incidents of interference using the head on/side on and back view cameras. Mr Lloyd was supported by the rider of REPUBLICAN STAR, Mr Ryan Bishop, who said that at times, STEP WISELY was "leaning over me".

Mr Jarrod Todd, the rider of STEP WISELY pointed to each of the three incidents alleged by Mr Lloyd. He pointed out that contact occurred only twice and not three times, as alleged, and that Mr Bishop did not have to "stop riding" and that REPUBLICAN STAR was not taken off its racing line.

Stipendiary Steward Mr Stewart Ching was invited to comment on the protest. He said that the Judicial Committee should take cognisance of the margin of a nose, but that any contact which occurred was light, and that Mr Bishop, even though he had to stop using the whip for a stride or two, did not have to "stop riding.

DECISION

--

We are satisfied that, by virtue of the horses coming into contact on at least two occasions, by STEP WISELY moving off its line as it ran down the straight, interference did occur.

--

However we observe that the interference, such as it was, was unlikely to have affected the chances of REPUBLICAN STAR. The contact was light and did not have the effect of moving REPUBLICAN STAR off its line or off its stride, or unbalancing it. Furthermore, Mr Bishop, the rider of REPUBLICAN STAR was able to continue to ride his mount with all of the necessary vigour that is required at the concluding stages of a race.

Because we have made a finding that the interference did not affect the chances of REPUBLICAN STAR, there is no need for us to consider whether or not to exercise our discretion and to change the placings.

The protest is dismissed.
