Ms E Whittle has been charged with careless riding as a result of an incident in Race 2.

It was alleged as follows:

"E Whittle, rider of "Outback Fox" allowed her mount to shift when not clear, taking the line of "Wellesley" (L Robinson) near the 500 metres, and forcing him over more ground."

Ms Whittle pleaded guilty to the charge, which is therefore deemed to be proved.

--

When looked at in isolation, the incident was not the worst case of careless riding that we have seen. There was no allegation of contact between horses but clearly, Ms Whittle moved her mount outwards when she was not her own length and another horse length clear, as is required by the Rules of Racing.

Mr Robinson was inconvenienced by being taken out over extra ground, instead of him being able to maintain the line that he was entitled to maintain. The incident did have the potential to become more serious.

Ms Whittle did not challenge the allegations that were made against her. She told us, through her employer, Mrs D Pitman, of an incident which occurred at the start of Race 1. Her mount reared in the starting stalls and Ms Whittle incurred a knock to the head. Mrs Pitman invited us to show some leniency with regard to the question of penalty, as she said that Ms Whittle was "not herself". She felt that the knock to the head may have affected her judgment as she said that Ms Whittle would not normally have ridden in that fashion.

If Ms Whittle was suffering from a mild concussion as a result of the knock that she received, then rather than a mitigating factor, we see this as being an aggravating feature. Ms Whittle had a duty to report her injury to the doctor or to the Stipendiary Stewards. By riding with a mild concussion, she may well have placed herself and others at risk.

PENALTY

We see no reason to depart from the practice of suspending apprentices, rather than imposing fines, in this case.

Credit must be given to Ms Whittle for the early admission of the charge, and credit is also given for Ms Whittle's good race riding record. Ms Whittle appeared before the judicial panel in October 2006 for the first time in her riding career on a charge of careless riding. Ms Whittle's carelessness, was, in our opinion, at the lower end of the scale.

Ms Whittle confirmed to the panel that she only rides at South Island meetings.

DECISION

--

The starting point for penalty for careless riding is a three day suspension. However, taking into account the mitigating factors referred to above, we are prepared to reduce this penalty to that of a two day suspension. Therefore, Ms Whittle is suspended from race riding from the conclusion of racing on Wednesday 31 January until the conclusion of racing on Thursday 15 February 2007 - 2 days.
