As a result of an incident in Race 4 at the Canterbury Jockey Club’s meeting on 27 February 2010, Licensed Jockey J Laking was charged with careless riding pursuant to Rule 638(1)(d) of the Rules of Racing.

THE FACTS

--

As a result of an incident in Race 4 at the Canterbury Jockey Club’s meeting on 27 February 2010, Licensed Jockey J Laking was charged with careless riding pursuant to Rule 638(1)(d) of the Rules of Racing.

It was alleged that Mr Laking permitted his mount “DR DEE BEE” to shift inward near the 1100m mark when not the required distance clear of “IMANI” (D Bothamley) which was dictated inward on to “OVERDRAFT” (J Morris) which clipped heels and blundered.

Mr Laking admitted the charge, which is therefore deemed to be proved. 

--

The incident was demonstrated to us by Assistant Stipendiary Steward, Mr J McLaughlin.  Mr Laking started from a wide barrier draw.  He came across the field quite sharply, and as a consequence, Mr Bothamley was taken in on to the line of Ms Morris.  Mr Bothamley’s line was dictated by Mr Laking on “DR DEE BEE” and as a consequence, Mr Bothamley moved on to the line of Ms Morris, whose mount clipped a heel.  Ms Morris was nearly dislodged from the saddle.

In response, Mr Laking confirmed that he did come across quite sharply, and that he made it tight for other horses, but said that he had actually straightened up before Ms Morris clipped the heel of the horse in front.

PENALTY SUBMISSIONS

--

Mr Davidson said that Mr Laking has a very good record, and has not been charged with careless riding since July 2009. 

--

He described the degree of carelessness as mid-range.  He said that Mr Laking’s actions meant that other riders were crowded, and that the consequences could have been a lot worse than they turned out to be.  He submitted that Mr Laking should be given credit for his early guilty plea, but believed that a suspension in the region of two weeks should be imposed.

Mr Laking did not have any particular submission to make with regard to the issue of penalty.

PENALTY DECISION

--

We agree that the degree of carelessness was mid-range, and that it was indeed fortunate that Ms Morris did not fall. 

--

We questioned Mr Laking carefully as to his riding engagements over the next couple of weeks, and he advised us that he was anticipating riding at Hastings on Saturday 6 March as a consequence of most North Island jockeys being in Auckland for Derby Day.  Mr Laking was invited to make submissions with regard to the deferment of the coming into effect of the period of suspension, but he advised the hearing that he did not wish to make such an application.

Having considered all matters, we agree that a suspension is appropriate.  Mr Laking will be suspended from the conclusion of racing on Saturday 27 February 2010 until the conclusion of racing on Thursday 11 March.  As we calculate it, this will mean that Mr Laking will be unable to ride at Omakau, Hastings, Cromwell and the Canterbury Jockey Club.  He will be free to commence riding at the Otago Racing Club’s meeting at Dunedin on Saturday 13 March.
