Information 7415 alleging a breach of the Rules of Racing, Rule 871 (1) (d) in that in the home straight, on the first occasion, Mr M Ryan allowed his mount to shift in when not clear of MR BOJANGLES which had to be checked and lose running to which it was entitled. Informant ? Mr S Ching, Chief Stipendiary Steward.
--As a result of an incident in Race 1, The Coca Cola Gallop South Long Beach Hurdles, Mr Marc Ryan was charged with careless riding. The information alleged that in the home straight, on the first occasion, Marc Ryan allowed his mount to shift in when not clear of MR BOJANGLES which had to be checked and lose running to which it was entitled.
--Mr Ryan admitted the charge, which was therefore deemed to be proved.
--Stipendiary Steward Mr A L Ray showed the hearing the incident from three separate angles of video coverage. Mr Ryan allowed his mount to shift across the line of MR BOJANGLES ridden by Mr Tane Belsham, when not his own length and another length clear. In explanation, Mr Ryan said that before allowing his horse to slide across, that he had checked behind him but it seemed to him that Mr Belsham had ridden up inside him. Mr Ching submitted that the carelessness on Mr Ryan's part was middle of the range, and called for a suspension. He advised the hearing that Mr Ryan has not been charged before pursuant to this Rule.
--Mr Ryan told the hearing that he has been riding in New Zealand since June 2006, and that prior to that his riding was in Ireland. He said that he has not been charged for a riding offence in Ireland, either. He called on his good record and asked for leniency.
--PENALTY
--Mr Belsham's safety was compromised by Mr Ryan's carelessness. There could easily have been a fall which would have had disastrous consequences having regard to the position of other horses at that time. A lengthy suspension could easily be justified. However, we must give Mr Ryan credit for his immediate guilty plea to the charge, to his good record and we must also take cognisance of the fact that there is a recognised shortage of jumps riders in the South Island, with the jumping season upon us. Thus, whilst a suspension is justified, we intend, instead, to impose a fine which we set at $600.00.
