DECISION AND REASONS:

Following the running of Race 1, Rotary Club of Hornby Maiden, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr T R Moseley, alleging that Mr Moseley rode carelessly in that, as the rider of TACOMA in the race, with approximately 400 metres to run he moved outwards and made contact with ITS ALL BETTER (J C Bates) on a number of occasions and caused ITS ALL BETTER to become unbalanced.

Mr Moseley was present at the hearing of the information and did not admit the breach.

Mr Ching showed video replays of the relevant part of the race and made submissions. He also called Mr J C Bates, the rider of ITS ALL BETTER, to give evidence.

Mr Moseley used the video replays and made a statement by way of presenting his defence to the charge.

Following a deliberation the Committee delivered the following oral decision:

"We have listened carefully to the evidence of the parties and we have viewed the video replays of the incident. Mr Ching alleged that Mr Moseley had pushed into a half-gap to make room for himself, as a result of which his mount came into contact with Mr Bates' mount on 4-5 occasions. This was confirmed by Mr Bates who said that there was no room on his inside for Mr Moseley's mount and at best, he said, there was a "half-gap". Mr Ching said that Mr Moseley was attempting to improve and, in doing so, took a chance on the gap opening. Mr Bates had held his line and Mr Moseley had attempted to push him out of the way which was careless riding, Mr Ching said.

Mr Moseley's defence was based on his assertion that he was in behind Mr Laking's mount (ABOVE SUSPICION), he had angled out from behind, he said, and he had asked Mr Bates for some room. When Mr Laking's mount began to give ground, he had committed himself to the gap, Mr Moseley said. Mr Moseley alleged that there had been gradual movement from the inside which had dictated his line once he had committed himself to the gap. He said that he would have laid off but for the horses in front moving out.

The Committee is satisfied that Mr Moseley's actions amounted to careless riding. Mr Moseley's mount was clearly full of running and Mr Moseley was looking for racing room. We find that he attempted to take a gap that was not fully there. Mr Bates held his line, as he was entitled to do, but Mr Moseley persisted in attempting to make room for himself and made contact on 4-5 occasions with Mr Bates' mount. We prefer the evidence of Mr Ching and Mrs Bates in relation to the incident and, further, our own interpretation of the video evidence concurs with the evidence of Mr Ching and Mr Bates. In particular, we do not accept Mr Moseley's contention that Mr Laking's mount was giving ground which forced him to take action to avoid its heels.

Accordingly, we find the charge to be proved."

Mr Ching informed the Committee that Mr Moseley had one careless riding charge proved against him in the previous 12 months ? at Waikouaiti on 1 January 2006 ? for which he was fined $475.00. Apart from that, his race riding record was "exemplary". Mr Ching submitted that the interference was "middle range" and that a suspension was warranted. Mr Ching informed the Committee that Mr Moseley was intending to travel to China at the end of the month.

Mr Moseley explained that he had four rides as an invitation rider on a sister-city trip to China with the Canterbury Jockey Club. He stated that he would be back for the next meeting at Riccarton on 14 October. He was forgoing two local race days in going to China for the promotion. Mr Moseley requested the Committee for a deferment of his suspension to enable him to ride on the trip to China. This was not opposed by Mr Ching.

Mr Moseley submitted that the degree of interference was minimal and he had not endangered Mr Bates.

The hearing was adjourned to enable the Committee to deliberate on the matter of penalty. Following the resumption of the hearing, the Committee delivered the following oral decision:

"The Committee accepts Mr Ching's submission that a suspension is called for in this case. We do agree with Mr Ching also that the degree of carelessness in this case may be categorised as mid-range.

--

The Committee is prepared to defer the commencement of your suspension, Mr Moseley, to enable you to ride on your upcoming trip to China. We are able to defer a suspension in exceptional circumstances which we deem your trip to China to be.

--

--

In determining the term of suspension, we have taken into account your good race- riding record. You will be suspended for 3 riding days commencing from the start of racing on Saturday 14 October 2006 up to and including Saturday 21 October 2006."

The meetings encompassed by the period of suspension are Riccarton on 14 October, Wyndham on 21 October and Rangiora on 22 October.
