Miss Werner having admitted the charge, it was found proved.  

Penalty:

Miss Werner’s Apprentice Jockey’s licence was suspended for a period commencing after the close of racing on Saturday, 26 September 2015 up to and including Thursday, 8 October 2015 – 3 Central Districts meetings. The three meetings are at Waverley on 1 October, Hastings on 3 October and Pukekura Park on 8 October. 

Facts:

Following the running of Race 3, Linwood Park Stallions Maiden, an information was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Apprentice Jockey (Class B), Miss L K Werner, alleging that, as the rider of TALLEMOSA in the race, she “allowed [her mount] to shift inwards when not sufficiently clear of HIGH IN DEMAND (S L Wynne) which was checked”.

Miss Werner was present at the hearing of the information and she indicated that she admitted the breach. She was assisted at the hearing by Mr K Harrison, Stable Foreman for her employer, Mr K T Myers.

Rule 638 provides as follows:

(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
    (d) careless.

Mr Davidson had Stipendiary Steward, Mr L Tidmarsh, show video replays of the relevant part of the race. He pointed out TALLEMOSA, ridden by Miss Werner, racing approximately four horse widths off the rail in the home straight with approximately 400 metres to run. Behind, and to the inside of TALLEMOSA, was HIGH IN DEMAND (S L Wynne). Miss Werner was riding her mount with vigour at that point when it commenced to shift ground inwards. TALLEMOSA shifted in some two horse widths, while Miss Werner continued riding the horse out, into the line of Miss Wynne, whose mount was checked. Miss Werner was not her own length and another length clear at the time, Mr Davidson submitted.

Mr Harrison said that the interference was obvious. Miss Werner had not been sufficiently clear when she shifted inwards, he said.

Miss Werner said that she should have stopped riding and straightened her mount earlier. She had not been aware of the extent of her inwards movement at the time, she said.

Submissions for Penalty:

Mr Davidson told the Committee that Miss Werner has had 24 rides in a brief riding career (since 9th August) and has already ridden 3 winners. She is a “promising apprentice”, he said. On this occasion, she did not look – she had her head down and was riding her mount forward. She should have made an effort to straighten her mount, Mr Davidson said. This was her first visit to the South Island but she would be described as “a Central Districts rider”.

The breach was not low end but, definitely mid-range, Mr Davidson submitted. He submitted that an appropriate penalty was a term of suspension for 2 to 3 Central Districts days.

Reasons for Penalty:

In determining penalty, the Committee took a starting point of a 5 days’ suspension as suggested in the Penalty Guide. From that point, Miss Werner was entitled to a discount of 2 days for two mitigating factors – her frank admission of the breach and her previous good record, albeit from a brief riding career. The degree of seriousness was, in the Committee’ view, a neutral factor.

Miss Werner sought a 7 days’ deferment of any suspension as her employer, Mr Myers, has engaged her to ride PADDY McGUIRE, which she rode to win its last start on 12 September, at Pukekura Park on 26 September. Mr Davidson had no objection to the deferment sought. The Committee was prepared to grant the deferment.
