the 300 metres, causing "Knots" to be checked.
THE FACTS
--As the result of an incident in Race 6, Mr JR Todd, Licensed Jockey, was charged
with careless riding pursuant to Rule 871(l)(d) of the Rules of Racing.
Mr Todd pleaded guilty, and the charge is therefore deemed to be proved.
--Mr M Davidson, Assistant Stipendiary Steward, demonstrated the incident which
gave rise to the charge on the video coverage from three different cameras.
Mr Todd was riding his mount hard at the time, but when the horse was under the
whip, it moved outwards, taking the rightful line of "Knots", ridden by Mr J Laking.
Mr Laking had to pull his mount off the heels of "Augusta". Mr Todd's mount, and
to move to a different running line.
In explanation, Mr Todd said that when the horse started its outward movement he
stopped riding with the whip, rode hands and heels for two to three strides, but the
horse moved outwards again when he recommenced riding with the whip.
Mr Cole submitted that Mr Todd should be given credit for his guilty plea, but
notwithstanding Mr Todd's otherwise good record, he felt that a four day suspension
should be imposed. Mr Todd stated that because he has some good rides coming up,
that he would prefer a three day suspension and a fine.
PENALTY
--Rider safety was compromised. Mr Laking was unbalanced by the incident and was
also deprived of a clear run to the winning post. The carelessness, in our view, was in
the medium to high range.
Therefore, a suspension is the appropriate penalty in this instance.
--Our starting point for the suspension would be a period of five racing days. However, we will
--afford credit to Mr Todd for his good record, for his early guilty plea, and for his candid
--explanations to this hearing.
--Therefore, the period of suspension will be three days effective from the close or racing on Monday
--21 April 2008 Wingatui until the close of racing on Thursday 1 May 2008, which will mean Mr Todd
--will be unable to ride at Marlborough on 24 and 27 April, and at Riverton on 1 May 2008.
--That is not all. Mr Todd will also be fined $250.
